Do I need a joint sponsor for my AOS (K1)

Hi,

I am at a loss.

I thought I could file for AOS by myself and I did a ton of research, however we decided that it would easier and less risky to work with a third party, RapidVisa.


We were told by RapidVisa that we need a joint sponsor since we only have the most recent year of tax returns (our income is above the poverty guidelines). The other 2 years my husband didn t make enough money and didn t file taxes.

Now, I read somewhere that you can t get a joint sponsor when you make over 125% of the poverty guideline. Also I read the USCIS only looks at the most recent tax year.

So what are we supposed to do?

Do we need to get a joint sponsor now or for down the road?

Please help a non-immigrant out here!

Extending the I-129f Approval

Hi everyone, due to covid-19 we have not been able to get an interview at the US Embassy (I'm sure many of you have the same issue). I noticed that my NOA2 has an expiration date, how do I go about extending that expiration?

I have seen advice to email the embassy, but they told me that USCIS approves I-129f's and not the embassy.

Hi everyone!

Little backgroundstory before my actual question:

I am Dutch, my husband is a USC. We filed CR1 in oktober 2018 and are now at NVC, waiting for 1 more document to be approved and my interview at some point.

My current problem:

Februari 13th I came to the USA on an ESTA, to visit my husband. Due to COVID19 I'm still here. I can stay for 90 days which would be May 13th. My ESTA expires May 11th.

I have a return flight, which we changed to May 4th now.

I would like to know if there is a possibility for me to extend my stay here?

In my home country I live with my parents, waiting for my visa to get approved. My dad is 70 and has asthma and has not been doing well lately. I don't want to put him at risk, but I also have no clue where else to go. Staying with my husband in the USA would be the easiest and safest option.

I have read that as the spouse of a USC, it's forgiven to stay in the USA illegally as long as you don't stay longer than 180 days in total. I just can't figure out if this is true or not, and I don't want to put my current visa process at risk.

Does anyone have information about this? Or know what my options are? Any help is appreciated!

I just received an email that my oath ceremony has been scheduled.

This is an email only! There is no other information about it on myuscis or egov.

My ceremony (end march) was cancelled due to the covid. this notice does not mention re-scheduling it is identical to the first "ceremony scheduled" email sent months ago.

Hi all,

I am new here but have been following the site for quite a while now and have read up a lot across the forums. I feel uncertain about the current situation and would appreciate your insights. Thanks in advance!

So I am Dutch citizen, married to a USC. We put in our I-130 petition last year June and got DQ from NVC last month. I have entered the US last week on ESTA to visit my husband. Our plan was to keep our consular CR-1 processing as we have already made it this far. But given the recent events with embassies being closed for visa processing, the travel ban and the announced EO (which really was the last straw that made us feel very uncertain)...we feel like things are changing really fast and we have no idea how long we would be separated when I return home. We both didn't really know the process of AOS until now and wonder if that would be an option as we don't wish to be separated from each other with no end date in sight. Like other posters have pointed out, we wonder if it is wise to be abandoning CR-1 process now? Is there a difference in chances of getting approved/rejected between the two methods?

The whole situation is so worrisome, have been especially anxious when we were apart. Flying here was already an experience, I don't wish to imagine how it's going to be, me going home waiting for consular processing (not knowing when we will have an interview date and how to get medical) and to to fly back again. And the possibility of this a too long a process that my husband will want to visit me in The Netherlands in the mean time.

Any thoughts are appreciated! :) thank you
