Hi guys,

I have recently received my combocard and have been thinking about a trip to the Czech republic to visit my family. These are difficult times and while there is no family emergency (luckily!), I miss my family and want to make use of my AP to visit them.

Since I'm a Czech citizen, I should be allowed to enter the country and I found out that in my home country I'll need to take a COVID test within 72 hours of arrival, which is not a problem.

My question is how about returning to the USA? Will I need to quarantine or take a test after returning? Does anybody have a recent experience?

And also, is my USC spouse allowed to accompany me?

RFIE tax question

Hi!

This morning my RFIE came in. I'm resubmitting form I-864 but I have a question about the financial evidence needed because I think that's where I messed up last time.

The situation:

- My husband never filed until 2019 because he wasn't required to (not enough income, we are using a co-sponsor)

- He filed his 2019 taxes through mail (he can't create an online account because he doesn't have financial proof aka credit card, student loan, auto loan etc) in June, before the new COVID-19 deadline

- Since the IRS is so behind on everything he won't be able to get his transcript in time, so instead he wants to write a letter explaining why he didn't file in 2017 and 2018 and explain that he DID file in 2019 but that his transcript isn't available yet and that's why he's including his 1040 and W-2 instead

I'm also including a legitimate copy of my co-sponsor's birth certificate because I sent them a bad scan last time which wasn't accepted as stated in the RFIE.

Am I missing anything? Should I also include his W-2s for 2017 and 2018 even though he didn't file, to show that he didn't make enough to be able to file and do I have to attach paystubs?

Also, when resubmitting I-186, do I have to include everything I initially included in the package (husband's birth certificate etc) or just the form?

Combo card or separate EAD and AP?

I just received a message that my EAD was going to be printed and I should receive it within 30 days (hooray!). It didn't mention the AP and also I haven't had any updates on my AP - it's outside of processing times, so I inquired about the status a week ago and were told they'd investigate and let me know...within 30 days :unsure:

The USCIS website reads that some applicants get a EAD+AP in 1 card, but it's not clear to me who qualifies. (Obviously, speaking of ppl who applied for both AP+EAD at the same time).

File I-751 without green card copy

Fellow VisaJourney-ers,

Due to a misdelivered Green Card and long processing times at USCIS I am now in a peculiar situation and looking for some advice.

History

  • On May 16, 2019 we had a successful interview and a green card (conditional permanent resident card) was going to be sent to the address of my wife's parents. While we were backpacking in South America, they received a letter from USCIS, which we assumed to contain the Green Card. When we returned from our holidays in August 2019 we realized the letter only contained a Notice of Action and that my Green Card had not been delivered. After several phone calls with USPS, they informed me that based on the GPS data they're convinced that the mailman (that was covering for his sick colleague that day) delivered the item to a mailbox on the correct number but on the wrong street. They tried to recover the lost item but were unable to.
  • On August 2019 I filed Form I-90 (application to Replace Permanent Resident Card) online under the reason "DHS issued my card but I never received it".
  • On July 21, 2020 I received the response that they denied my request because the card was not returned to USCIS by USPS as undeliverable. They indicate that I should file Form I-90 again with the reason of filing is that my card was "lost, stolen or destroyed" and add the corresponding fees ($455+$85 biometrics). Alternatively they state the option to file Form I-290B, Notice of Appeal or Motion.

Problem
In May 2021 my conditional permanent resident card will expire and I need to file Form I-751 within 90 days of the expiration date. This form requires me to attach a copy of the conditional permanent resident card which I don't have and cannot obtain in time either (due to the long processing times on Form I-90).
My proposed solution
File Form I-90 with the reason for application being "My previous card has been lost, stolen, or destroyed". I will not receive the replacement green card in time (before May 2021) and the filing fee will be lost but it will give me another Notice of Action. In 2021, file Form I-751 and instead of attaching a copy of the Conditional Permanent Resident Card, I can attach:
  • Form I-90 Notice of Action (08/28/2019)
  • Form I-90 Termination (07/21/2020)
  • Form I-90 Notice of Action (TBD)
Also, as soon as the (expired) Green Card gets delivered, I could make a copy of the front and back and send it to USCIS as a belated attachment to my case.
Questions
  1. Do you guys recommend going down the path of the potential solution that I described above? If not, what do you recommend?
  2. I need to know the expiration date of my Conditional Permanent Resident Card but I don't have the card. Will it expire exactly two years after the interview date (thus expire on May 16, 2021)? Or is the expiration date linked to the day the card was produced and therefore unknown?

Forgot to save copy of DS-3025

Good Morning,

Last October I had my Medical Examination done In the Netherlands, after my K1 Interview in November I received a package which needed to be opened by a CBP upon port of entry.
In my package was my whole sealed file for them but also a copy of the completed DS-3025 for myself. I arrived this year in February and got married at the end of February. I sent my AOS package with my only copy of the DS-3025 at the end of March. Now I completely forgot to make a copy of that form or keep it for my own administration.

I got scheduled for an interview and I'm waiting for the letter from the USCIS with the date. For the interview you need a copy of your whole package but also the I693 IF you havent sent the DS-3025. Now I did send this form in my package and never received an RFE or something saying its not correct.

I'm worried that I'll have issues with my interview because I don't have a copy on hand of the DS-3025. I called a civil surgeon here and testing is over $300.. I am wondering and seeking for advice, if its even necessary to get another medical or if they'll just have my DS-3025 from my package available at the AOS interview.

I worry quickly but I don't want to mess it up by this thing of forgetting to copy the DS-3025 for own keeping..

If anyone could advise me, I would really appreciate it! :):)
