Hi,

After our I-130 was approved two weeks ago, we've initiated the process of submitting documents for DQ. One challenge I'm trying to understand is how to handle income verification, given that my 2023 taxes were filed in September, but the transcript isn't yet available. I believe this might be related to filing a W7 in tandem with my return.


As a result, my most recent tax year is still 2022 in my transcript account, but I've seen online suggestions that it's not advisable to use this year after the April filing deadline. To address this, I'm considering setting my most recent tax year to 2023 and providing the following supporting documents: (1) copy of filed Federal tax return, (2) W-2s, 1099, and any other schedules, (3) paystubs, (4) a notice of extension to file, and (5) an employer income verification letter. The remaining years will be provided via return tax return transcripts once they become available. I was also wondering if it would be wise to include the 2023 'Wage and Income Tax Transcript' with our submission.

Should I say yes for "Have you filed a Federal income tax return for each of the three most recent tax years?" despite it not being in their records or set that to no?

I'd appreciate any insights on our situation. Is it advisable to wait for the 2023 tax transcript, or should we proceed without it? I'm concerned about the potential delay to get DQ'd caused by RFEs :(.

Juarez medical failed due to marijuana test - what to expect next?

My fiance was denied entry (1 year ban, no required tests) after she failed her medical in Juarez in January. We're approaching the end of that timeline. Needless to say, lessons learned.

I'm having trouble figuring out what is next. We know she needs to retake the medical in Juarez. But beyond that, how do we proceed with the consulate? I know we likely need to re-up on time sensitive info like continued proof of the relationship and her police report.

Do we need to reschedule with the consulate? How do we get her passport to them for the visa assuming all works out?

Hello,

My fiancee recently attended her medical appointment in Ciudad Juarez. Unfortunately her chest x-ray contained one small spot that was questionable because she recently recovered from Bronchitis but the doctors want to do further testing for Tuberculosis, the preliminary test was negative but they are waiting for further results that will take 70 days.
However, she also received an email from her consulate in Merida that says she is not eligible for a Visa and is required to return it. Has anyone heard of this happening?
Does the embassy revoke tourist visas on such cases?

Hi all! Looking for similar situations to see what we have to brace ourselves for.

We are currently awaiting approval of I-130 based on marriage to US citizen both living abroad in MX. My spouse attempted to cross illegally twice in 2021 & 2022 respectively. The first time he was kicked back to Mexico within hours and the second time he got as far as the Falfurrias inspection station. FOIA only shows this second encounter. He is under the 180 days of illegal presence, but I see conflicting information if this triggers a bar or not. Per USCIS guidelines its only after accruing certain time of unlawful presence but I have seen second hand accounts of waivers being required for these situations. Would love to hear similar situations.

State police certificates vs Federal - Mexico

I'm trying to wrap my head around this. The Juarez consulate specific instructions state that the following evidence is required for the interview:

Original and copy of the police certificates from all places where the applicants have lived for six months or more since
the age of 16.

My fiance has lived in two states. She currently resides in the state of Chihuahua, but previously lived in Coahuila.

Does this mean that my fiance will need to travel to Coahuila to obtain a police certificate from there (in addition to getting a local one from Juarez) or is the federal one sufficient for the Juarez Consulate requirements?
