Hello All,

Obligatory, if already created please remove/provide the link to existing topic. But after searching I did not see a thread for those who filed their I-130 in December 2023.

I (US Citizen) am filing for my husband (Mexican citizen). He crossed the border illegally as a kid (not DACA) and has been here for over 15 years. I know we will have to file an I-601a (or I-601 still not sure which will be needed). Does anyone know when during the process the I-601a should be filed? Actually, the order of all forms would really help just for peace of mind and reassurance, I have been down the rabbit hole and terrified with what some of these lawyers put their clients through.

Visa Journey:

Nov 21, 2022: finalized with lawyer to begin the process.

Dec 5, 2022: I-130 was submitted.

Dec 9,2022: Received account acceptance notice. Nebraska Service Center, I have seen some say they started with Nebraska but got switched to a different center (fingers crossed it's not because everywhere else other than California has longer processing times).

Jan 7,2023: Case is actively being reviewed.

While logged into my account the Processing Time tab states that my estimated time until case decision is 3 months. however, the Check Case Processing Times site (egov.uscis.gov/processing-times/) put it at 10.5 months. Is there a reason why they don't match?

I-864 Affidavit of Support question for I-130

I'm just curious if the Spousal Visa involves the I-864 or not. If it does, I work as an IT contractor. I do pretty good but my jobs are sometimes 3 months, and sometimes 3 years. I usually intentionally take a month off in between jobs. If USCIS asks for the I-864 during one of my off periods, will that be an issue?

I am finishing up assembling my wifes I751 petition.

To be sure I'm sending a decent petiton and evidence, posting here for any ideas on what I may have missed while sending in.

Enclosed please find a JOINT I-751 petition for removal of conditions of permanent resident status regarding my wife, Yared Thompson, and her son . Please also find a USCIS form G-1450 authorization of credit card transaction of $765 for this form. My wife entered the US on a K-1 visa and her son entered with her on a K-2 visa. We are all happily living together and request that this petition be accepted for removal of conditions on the residence of my wife and her son.

This package includes the following:

USCIS form G-1450, Authorization for Credit Card Transaction

USCIS form G-1145, Notification of Petition Acceptance

USCIS form I-751, Petition to Remove Conditions on Residence

The following documents are provided to show evidence of our bonafide marriage,

It states to funrnish required evidence including:

  • Evidence of the bona fides of the marriage, if petitioning for a spouse:
    • Documentation showing joint ownership of property;
    • A lease showing joint tenancy of a common residence, meaning you both live at the same address together;
    • Documentation showing that you and your spouse have combined your financial resources;
    • Birth certificates of children born to you and your spouse together;
    • Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. Each affidavit must contain the full name and address of the person making the affidavit; date and place of birth of the person making the affidavit; and complete information and details explaining how the person acquired their knowledge of your marriage; and
    • Any other relevant documentation to establish that there is an ongoing marital union.

We have none of these since I live in Colorado and she lives in Mexico. The o ky option is for an affidavit, what exactly are they looking for this to say?

Hi All,

Just for the sake of educating ourselves, what is the roadmap for the processing of an I-130, I can't seem to find a stright answer.

What i mean is, we have submitted, our application and received the first I-797C notifying us that Nebraska has our case.

What comes next? Then after that? Then after that?
