Well after waiting for an answer from our RFE response, I got an electronic notification today that our petition has been denied. I'm sure most people who have been denied quickly leave this forum all together but I could really use some advice. I have not yet received the letter, so I have no explanation for exactly why we were denied but I would think it would be safe to say it is related to our RFE. It said the letter would explain the reasons and what our options are but I have read on here that there are NO options after being denied a K1. I guess I'm reaching out to anyone on here that has been through the same thing that could shed some light on where to go from here.

Hello,

So it s been 50 days since my lawyers sent our package, and we have no response at the moment. No approval no denial, nothing. I sent an email to my lawyer asking if the package was actually sent because a read here sometimes the lawyers say they sent it but they didn t.

So today my lawyer said it was sent on September 16, and received on September 19, but she thinks it s weird that the check hasn t been cashed yet. She said something we could do is cancel that check and send the package again, with a new check. Do you think that s a good idea.

Also, the law office is not cheat at all, they divided our payment into 3 payments and they re asking for the third and final payment, although we practically have nothing. We don t know what to do, because if they re barely paying any attention to us now that we still owe them money, what would happen when we re all payed up?

My wife and I live in Mexico, I m American and she s Hispanic. She s had a visa most of her life living close to the border but it s currently about to expire in February. If we start the process for a CR-1 will she also be able to renew her visa if the process takes longer? What would the best option be? Renew her visa before beginning the process? Thanks for any advice!

Hi all,

Thank you in advance for any help,

I little bit of background, I met this guy three year ago. 2 years ago we got engaged and moved in together (we have plenty of evidence like him being added to my car insurance, authorized user on my credit cards, phone plan, iCloud family account, etc). I'm a software engineer from Mexico working on a TN Visa currently making ~130k annually.

Now we want to get married and file for AOS around January next year. Only issue is that my fianc is not working (he's currently launching an app and has no income). Is my salary enough to satisfy the household income without requiring a sponsor? (we have had a lot of issues getting one) is 10 months left on my visa enough time for processing?

Help with I-864 Affidavit of Support...?

Hi,

I'm currently in the process of filling out the Affidavit of Support for my step-child but I have some questions:

1.) My husband became a Permanent Resident two years ago. I filed out the affidavit of support for him too back then. Am I able to add him as a co-sponsor? Do I need to? I make around $33,000 a year on average.(I think poverty level for 2019 is $26,000, or $32,000 if I have to bump my household size up to 4 and include my niece). My husband works full time and makes a lot more money and the tax forms I'm submitting have both of our incomes on them since we file jointly. If I can/should add him as a co-sponsor do I just fill out a separate form for him?

2.) My niece has been living with us for the past 3 1/2 years while her mom got herself some help so my husband and I have been supporting her and claiming her on our tax returns. In April of this year she was finally able to move back in with her mother full time. We won't be claiming her as a dependent on our 2019 taxes since her mom will be doing so. Do I still include her as part of our household? So my household number would be 4 instead of 3?
