I-944 Income and Education question

Hey Guys,

I am in the process of filling out the paperwork for concurrent filing the I-130 and I-485 when I realized that I have to submit an I-944. This form really has me losing hope.

Here is my situation:

1) My spouse (beneficiary) is a registered nurse with diploma from Mexico

2) She is not making any income because she is not authorized to work. I listed her on the form and explained that she would not file a tax return because she is not authorized to work.

3) I am currently working for the Government and will be making over 250% of the Federal Poverty level annually based on my annual salary; however, for 2019, my income was $2,000 for the whole year because I was on a sabbatical.

4) My spouse did receive pregnancy related Medicaid. I have letters from the county which clearly state that she was only approved for pregnancy related medicaid and the start and end dates.

5) She has no serious medical conditions and has no medical insurance because most insurance companies require that you have an SSN or ITIN. She will qualify to be put on my Government health plan once she receives an SSN

6) My parents will be filing a I-864a to Sponsor and between the two, they make about 300k per year so with them alone, it will qualify.

Here is where I am getting worried:

1) I can only provide a picture of the diploma that her family member sent from Mexico. I am wondering if this will suffice or if they will require the actual document? Obtaining the actual document will be a pain in the butt.

2) Will they immediately deny the application because she makes no income and because my 2019 tax returns show an income of $2,000? Will they at least take into consideration recent pay stubs and the fact that my parents will co sponsor?

3) For the medicaid, I believe there should be no issue because I have letters to prove that it was for pregnancy, as well as, the start and end dates. Should I be worried? Also, I read somewhere that if it was pregnancy related, I would not need to mention it; however, the form I-485 asks what the medicaid was for. So I assume it does have to be mentioned either way?

I know this form is new and there may not be much information regarding the above questions, but I am hoping to get input from people who have had similar income and education situations and what USCIS said to them.

Need advice for work visas:

My husbands nephew has a degree in communication and advertising and would like to come to the US under a work visa. I work for a company that could hire him for sales and is willing to help with this process.

what s the visa that he would need to apply for? And can we do this process on our own without a lawyer? I was able to get my husband citizenship without a lawyer, but that was over 10 years ago. Hope I can do this for our nephew a save some $$$

I-864 or I-864ez or both?

Hi All,

We are starting the NVC process and we have a few questions.

I think we qualify to use the I-864EZ.

  • Be the petitioner who filed the original Form I-130 on behalf of the intending immigrant; my husband.
  • Be the petitioner who filed the original Form I-130 on behalf of the intending immigrant; he filed the I-130 only for me.
  • Be able to show sufficient income to support the intending immigrant based solely on your salary and pension, which amount is shown on the W-2 Form(s) provided by your employer or former employer; he make around 55k in 2019 and he's only using his income - no joint sponsor.

Do we need to file the I-864 as well? Or is it enough with the I-864EZ?

Also, do you know what's the "additional aos supporting documentation" that we need to upload? I see we have to upload the I-864 or EZ and we also have to attach the IRS Transcripts but do we need to attach anything else?

¿When is the right time to expedite at NVC?

Hey guys!
I really need insight on this one... So I am currently at the NVC stage, my husband paid the fees and we haven t subitted anything. When is the right time to ask for an expedite? Should I submit alll my docs and then ask for it? What happens if I send it, gets approved and I haven't subitted anything, how would that work? THANK YOU !

I am filling out my i-129f, I just finished law school so there are long gaps in my employment history since I have been a student. Will this be an issue in getting my i-129f approved?
