-Married in 2015 to USC wife while living in the US.

-Had interview and got conditional green card.

-Submitted I-751 and 7 months later, USC wife passed away. She was battling drug addiction & mental issues that prompted us to separate temporarily, and I had moved to a new place away from her. Her family wasn't too happy with me, but I tried to help her but there was no hope. She tragically passed away.

-I am submitting a waiver to USCIS as I got an RFE for changing address & proving that my spouse and I still live together. Consulted a lawyer and was told to submit a personal statement documenting what happened, and submit latest tax return documenting joint filing, as well as other financial documents showing joint accounts that have not been submitted to USCIS before. Lawyer also asked to submit a copy of the death certificate. I obtained the death certificate, and the problem is her family purposefully took me off as the surviving spouse. In the marital status area, it says "NEVER MARRIED". If I want to amend it, I need to fill out all these forms and mail them and they require 2 signatures from people who are versed on the facts. That would require me to go to her family for getting a second signature. The lawyer said I don't need to go through that trouble and should just submit the death certificate as is and just explain in my personal statement what happened. I'm just lost and don't know what to do as I don't want to raise any red flags here. I also don't want to go to the in-laws as I know they won't help me out here and probably just want me out of their lives.

Hello everyone,

I am posting this on behalf of my sister. She recently got her divorce finalized. While they were separated, she met someone else and they want to get married before the year ends.

The boyfriend has a student visa that is expired but is in status because he is still going to school. Can they get married and she can file papers for him immediately?

They have an age difference of 10 years, my sister is older than him, is this a red flag?

If they do not get married before the year ends, they will not have filed joint taxes but they have joint bills, bank account statements, car insurance which are like two months old. Is this sufficient enough?

K1/CR1 VISA REFUSAL IF I HAD A B1/B2 VISA CANCELLED?

Hi. I recently had my B1/B2 tourist visa cancelled because i overstayed one of my visits by 2 weeks (September 2017 to early April 2018) I traveled again with no issue this year (august 2019 - October 2019). I was to travel on December 11th but my visa was canceled a few hrs to my flight. I was wondering if it s going to be a problem while processing the K1 visa (since its a non immigrant visa) and if me and my fianc should just get married then apply for the CR1 visa. Thank you.

A friend just asked me this but I couldn't find a better way to explain.

Why's the processing times for I-130 for Vermont and Nebraska for let's say U.S. citizen filing for a married son or daughter over 21 different? Nebraska says 2 years while Vermont says 10 years.

I know, typically, depending on country of birth, this process should take years and not months.

I am recently married and am filing my CR1 (online) soon. In filling out the application it asks for the beneficiary's children. She has 3 kids, one of which is over 18 and is in University. Obviously we are not including that child in our application. How do we specify which children are included (and qualify)? There is a section to add "additional relatives". Is this where I add the 2 qualifying children?
