Rejected I-765 (used the old form)... Some questions inside, pls help.

So in case anyone was wondering, the US Govt does not f*** around when it comes to deadlines. They have absolutely no wiggle room when they set a date. "On or after the 25th" means get your stuff in by the 24th.

I sent my 130+485(incl. 131/765) on the 24th and it arrived there on the 26th via FedEx.

Yesterday I got letter from USCIS saying the 765 two reasons for rejection:

1. payment was incorrect or has not been provided

2. application was filed on an outdated version of this form

I think reason number 2 shoulda come first but all the same, my application was no good.

Question: They tell me to fill out the proper form and send it in with the rejection notice attached to the top. If i do so, will this still be considered concurrent filing? If so, will I need to pay the fee (working under the assumption that it will get it out today before the deadline)? Or since its technically coming later, it will be considered a separate filing and require fee payment (whether before or after Oct 2nd)?

FYI, I got texts for three other applications (the receipt numbers on those texts are different from the one in the rejection letter) so i'm assuming those are for 130, 485, and 131. This should answer any questions anyone has about whether they reject entire applications if one has a mistake, or whether they just reject the part that's wrong.

Not gonna lie, this was a little disappointing, but it's self-inflicted damage. Had i double, triple, quadruple checked everything, i would have caught this. Now i'm likely to cough up more cash than i can afford right now. And having wifey start working asap was a priority as things are getting tougher by the day. BUT, the 765 was never top priority... that was definitely just getting 485 to go through! I hope that whole part works out without setbacks.

At 5:00. This attorney or so he calls himself, does not know what NOA 2 is? Really?

Time to close shop, I guess. He claimed it was from FB, but that was not the worst part of it. He muddies himself further

I would seek a refund if I used him and he messed up my case.

We emailed the embassy today and got this response within a few minutes. Some hopeful news here for those of us whose interviews were canceled.

Should I file for Extension of Stay?

I sent our application for my wife's 130/485 (with 765, and 131) and it was delivered 8/26.

I've gotten no notification, receipt, and my account hasn't been charged the fees yet. In other words, no sort of feedback of any kind that my process has begun.

Her i94 expires in exactly 30 days, on October 22nd.

Should i just go ahead and file an extension of stay in the event that things don't work out on the 485 end? It's becoming more and more concerning as the days go by.

Info relayed to me:

  1. US spouse just turned 18 and got married.
  2. Never worked before (joint sponsor available)
  3. Prior to 18years, she never filed taxes as she was listed as a dependent on parents taxes

So the question: On her own I-864, how does she answer question 23a of Part 6? "Have you ever filed a tax return for the last 3 recent years?" Does she answer:

  1. YES because she on parents return? And if she does so, what will she fill for the $$ boxes for 2017, 2018, 2019?
  2. NO and check box 25? then go ahead and provide information saying she has never worked prior to turning 18 years? I am leaning to this as the answer
