On July 29, 2020, the U.S. District Court for the Southern District of New York enjoined the government from enforcing, applying, implementing, or treating as effective, the USCIS Final Rule on Inadmissibility on Public Charge Grounds (84 FR 41292, 8/14/19)during the COVID-19 pandemic. The court also issued a separate order granting an injunction that enjoins the government from implementing, or taking any actions to enforce or apply, the 2018 FAM Revisions, the DOS Interim Final Rule on Visa Ineligibility on Public Charge Grounds (84 FR 54996, 10/11/19), or the President s October 4, 2019 Proclamation, Suspension of Entry of Immigrants Who Will Financially Burden the United States Healthcare System in Order to Protect the Availability of Healthcare Benefits for Americans (84 FR 53991, 10/9/19) during the COVID-19 pandemic. https://www.aila.org/advo-media/issues/all/public-charge-changes-at-uscis-doj-and-dos As many of you have already been aware, the days old injunctions issued by SDNY have already halt some of the immigration visas at US Embassies or Consulates worldwide. Some people I know of or ready from the forum were told by CO that no visa will be issued until DOS has provided guidance. Wonder what would happen as our consulate interview is coming up in 2 weeks? Does that mean no need for DS-5540? Any ideas or thoughts?

Hi there, we are new to Visa Journey. My spouse is scheduled to be interviewed for the IR1 immigration visa at the US Embassy in Tokyo in 2 weeks. We are now preparing the documents and questions to be asked. Wonder if any fellow VisaJourney-ers could provide some points on: 1) What documents are required to bring to the embassy? We were told to follow the instructions on State Department embassy website regarding documents to bring to interview. Will there be other additional info to bring? 2) DS-5540 - the Public Charge form - it seems the embassy has stopped issuing immigration visa following the ruling on July 29th in SDNY which enjoined the implementation of the Public Charge policy. Yet, State Department still has not provided guidance on how to follow the ruling though USCIS did already. 3) What questions would the CO being asking my spouse? Like to hear some real case questions being asked at your interview. 4) Any other tips or pointers would be helpful? Best, TK

Hi, I have uploaded all my documents to the CEAC and submitted everything. However, I am still waiting for 1 criminal background check that has been a nightmare to get (out of 6 in total). I have the other 5 from all the other countries I have lived in, however for the 1 missing document I stated in the comments that the application is pending, in hope that I can present the missing background check in person at the interview as I will have it by then. Is this going to delay my interview process or have an impact on the case? Hope I have been clear in explaining this. Any help will be appreciated. Thank you.

Greetings my fellow forum friends, My wife and I are filling out the I-944 and have some questions on the liabilities/insurance sections. Are the liabilities to include mine as well (i.e. mortgage, credit card bills, etc.), or only her's? She does not currently have any debt, so I'm assuming I'd include mine. Also, for the health insurance question, I am going to eventually add her to my employer-provided coverage, but have not yet. I realize it may be a stupid question, but I'm assuming my wife selects "I will soon enroll" and includes the proof once I add her to my plan. Thanks again, everyone!
