<< Need your advice>> I-130 denied/ How to reapply I-130??

Hi guys

I need your advice and want to learn from your experience.

We( ) received a letter from USCIS an it said that they denied our case due to submission over due of RFE.

I almost fainted when I heard the reason from my husband because.... my husband clearly respond their requirement and sent additional docs to their office!!!

In my husband s opinion, they might lost the package somewhere in their office or the package just didn't reach to their office by some reasons.... (he was quite clam and said mail lost always happened in US )

The letter mentioned USD 630 for appealing but there is no guarantee that USCIS change their judgment so we are thinking about to reapply.

What we want to learn is following points.

1: whether we need to write additional letter to explain the reason of reapplication or not

2: What kind of docs would be preferable to add

Here is our case history ------------------------------

End of Apr. 2019 : Application sent to USCIS

May.7.2019 : NOA1 (Nebraska)

Mar.2020 : initial review

Apr.23.2020 : Case Transfer notice ( from Nebraska to Texas)
May.17.2020 : RFE

Jun.12.2020 : Sent additional docs to Texas office

Oct.30.2020 : Denial letter

---------------------------------------------------------------------

To be honest, I still hard to believe that our docs got lost somewhere..

(And mail lost never happen in Japan so totally doesn t make sense for me )

But we need to move forward so it s be really helpful if you could share your experiences and knowledge with us!!

Stay safe everyone!!

How long does USCIS make a decision after an RFE?

I dont know if I'm just overreacting but its been 124 days since the last time USCIS changed the status of my application (RFE response received) and I have not received any biometrics appointment yet, should I be worried? Or is it normal? How long does it take for them to make a decision after receiving RFE response? I sent them a message and they said they will send an inquiry to the National Benefits Center which is processing my case. Also I m sorry if I put this topic in the wrong place. Any advice or input is very much appreciated.

Hello everyone,

My wife and I successfully completed the spouse visa a year ago.

Can anyone tell me what the next step is for the conditional spouse visa? I remember there is a 2 year limit on the visa and that I need to fill out additional paperwork, but I cannot seem to find any information online. Any help would be appreciated.

I apologize if this is posted in the wrong forum.

Hi, my spouse and I want to file CR-1 visa.

For the form I-130, I have a question in Part 4.

"If filing for your spouse, provide the last address at which you physically lived together. If you never lived together. type or print, "Never lived together" in Item Number 59.a."

I'm a Japanese citizen and traveled/ lived in a couple of different countries in past 5 years, I have not really lived in Japan during in relationship with my American spouse...

1. Met my wife in Dec2018 during my trip for 10 days with visitor visa. *I had my living address in France.

2. I visited my wife in Apr-May2019 for 10 days with visitor visa. *I had my living address in France.

3. I came to the US from France and stayed in the US for 3 months with visitor visa.

4. I moved to Canada for study and stayed for 6 months. I visited her for 10 days during Christmas with visitor visa. She visited me in Canada for 5 days.

5. I'm in the US for 2.5 months with visitor visa and we got married last weekend. I'll fly back to Japan and will stay there until my visa is approved.

On the 3 and 5, I traveled in the US with my wife for her work. But she has a living address.

Should I put those term as lived together and put her address in my address history even though I was in the US with visitor visa??

Or should I put my home address in Japan on my address history during the term even though I haven't been back to Japan?

I know my history is complicated...

I hope someone can help me out...

Thank you for your help!!

Japanese Police Certificate Upload

Hi all,

My husband and I have gotten to the uploading of civil documents for the Consular Electronic Application Center. We are applying for a CR-1 visa from Japan.

He got his police certificate and we uploaded it to the website due to these instructions from here:

Special Seal(s) / Color / Format: Japanese Police Certificates are issued in a sealed envelope. If the seal is broken, the certificate is considered invalid. Visa applicants should not open a sealed envelope containing a Police Certificate. The applicant must bring the original Police Certificate in a sealed envelope to the U.S. Embassy/Consulate at the time of his/her interview. Applicants should only send a photocopy of the sealed envelope to the National Visa Center, but not the actual police certificate itself.

We scanned the sealed envelope and uploaded it.

Today, we got an email from the CEAC. The message said:

The police certificate required for JAPAN does not need to be submitted through CEAC. The issuing authority will send the police certificate directly to the interviewing consulate or embassy. Please use our Document Finder at https://nvc.state.gov/find for acceptable documents guidelines.

What???

This is super confusing- we are located in Japan so my husband could go get another police certificate, but do we need to?

I also cannot remove the Police Certificate upload from our documents.

I don't know what to do :< Any guidance?
