Conditional GC even if at the time of the interview I was married more than 2 years!

Hi all,

I just received my Green Card and I am beyond surprised that it expires after 2 years. I am guessing it is a conditional green card. This doesn't make sense to me. I thought that if at the time of the interview I was married more than 2 years with my USC husband, I will be getting a permanent green card that lasted two years. Are the rules changed or am I not remembering correctly?

Thank you!

Hello again everyone,

I applied for AOS on March 3thd and obtained the EAD combo on the first day of September. I took biometrics twice (still do not the see the reason why), once in August 8th and then on November 9th. Now, does anybody know when I should receive the invitation letter for the last interview, more or less, according to my timeline?

Thank you :)

I-130 Filers - ITALY - 2020/2021

Hello Everyone,

Since I didn't see a topic yet in the forum about CR-1/Ir-1 Filers from Italy, I thought I would create one.

I am a US citizen preparing to marry my fianc in Italy (who is Italian) in the next few weeks - January 2021 - and then we will file our I-130 petition to start the CR-1/IR-1 spouse visa process immediately afterwards. We are hoping that we will have a filing date of early February 2021 and hoping the process would go as fast as possible.

I wanted to start a topic here to gather other experiences from others who have filed petitions for Italy-based spouses to try to understand if there are any country-specific timelines or complications that we might want to know about.

I will update this topic once we have started our journey and I look forward to hearing from some of you. If, by chance someone know that there is already a topic of a similar nature, that I have overlooked, then please let me know and I will move this conversation there.

Thanks, everyone! And good luck to you all on a speedy reunification with your significant others!

Are the forms I-131 and I-485 processed separately?

Hi everyone, I hope that you are all having great holidays!

I am Italian, married to a US citizen, currently residing in CA.

My husband and I filled an AOS application in June 2020 and then a second time in August as the first application was rejected because we did not include the form I944... Which we did not include the second time either as it was not requested anymore.

Bus SURPRISE: we received a RFE asking to send them that form too as things changed in the meantime.

So basically because of this form we already lost 6 months and I'm wondering weather that means that also my application for the work and travel permit is being delayed or hopefully those are separate processes?

I don't mind waiting for residency permit, whatever time it takes , that's fine. But I have a critical situation at home and I really need to go visit my family ASAP.

So my understanding is that the actual processing of my AOS will start when they receive the 944 form.. But does that apply for the I-131 form too or as I did not receive any RFE for that, it means that it's being processed independently and there is hope to receive the travel permit in a couple of months? (it's my knowledge that it takes about 6-7 months to get it... Which would mean February or March 2021 for August 2020 applications).

Thank you everybody in advance

Hello everyone!

My husband and I are in the process of filling the visa application. He made sure he got everything needed for his visa and the interview. However his police certificate is still showing his open case from 2010. He was caught selling fake design bags in the street back when he was younger and was charged for it. now almost 11 years later his case is till open no judgment was done. He talked to his lawyer and he advised us to hold the application for couple of months to see if he can get a court hearing because he might get denied and they might think his trying to leave the country. I m so confused and any help will be appreciated.
