Hi there. Hoping for a gut check and guidance from this lovely forum.

Husband makes significantly more than the minimum needed for the financial support requirements on the 1-864.

However, he hasn t filled his 2022 taxes yet as our accountant told us to wait until I moved to the US and got my SSN to filed jointly (we don t owe anything so no penalties). We filed for an extension for the 2022 taxes.

We uploaded our 1-864 in July 2023 and the following:

- his tax returns for 2021, 2020, 2019

- 2022 w2

- several paycheques

- extension for taxes

- letter of explanation on the tax extension

- letter of employment.

We were then told his income was insufficient and a joint sponsor or further evident may be needed before my interview.

My interview is in the next 12 days.

We received an email from the embassy asking for his recent W2 and taxes. IRS efiling doesn t open until after 5 days after my interview and his job won t/can t issue a w2 for 2023 in time for the interview.

My question:

His father has offered to be our joint sponsor. He has all his tax transcripts from 22, 21, 20 and makes enough.

We plan to upload a joint sponsorship 1-864 this weekend and also provide new financial documentation like recent pay stubs, a letter of employment for 2023, our investment accounts etc. as well as a letter from our Accountant explaining the reason why they advised us to wait until now and a letter of intent to file as soon as efiling opens.

Will the joint sponsor and additional documentation be sufficient for the financial support side? Is there anything else I should bring/expect at the interview?

I am writing to seek your advice regarding the necessity of obtaining a J1 waiver for individuals who are not subject to Section 212(e), the two-year home residency requirement. My concern stems from a recent interview with a visa officer for my NIW-EB2 green card, who inquired about the J1 waiver despite my previous J1 visa explicitly stating that I am exempt from this requirement.

Given the critical nature of this matter and its potential impact on my ongoing processes, I would greatly appreciate your guidance on the following points:

  1. Is it customary for individuals not subject to Section 212(e) to still require a J1 waiver?

  2. In light of the visa officer's query regarding the waiver, could this indicate a change in policy or an oversight in my specific case?

  3. Understanding that processing times can vary, what is the typical duration for obtaining a J1 waiver under current processing conditions?

Your prompt response to these queries would be immensely helpful in navigating this situation and ensuring compliance with all pertinent regulations.

Proving Domicile?

Hi everyone,

My husband and I are in the very early stages of our Immigration journey. He is a US Citizen that has been resident in Ireland, where I am from, since 2017. He was on an Irish student visa for 4 years, 2017- 2020 and then he was on a Graduate visa for 2 years. We got married in Ireland in March this year and he was just approved for an Irish residency permit for one year.

We are now planning to relocate to the USA and he is enrolling in a Masters program, starting in June. To try to shorten the amount of time we will be apart, we want to file the petition for the CR-1 Visa as soon as possible but we are concerned about him proving his domicile at time time of filing, even though he will be living in the USA from June 2024.

Does anybody have any advice on proving domicile from outside the USA?

Can I travel before my oath ceremony date?

I recently got approved for both my I-751 and N-400 at my combo interview. The interviewer told me it would be 4 to 6 weeks before I got a letter inviting me to the oath ceremony.

I have read elsewhere that it could take 2 months or longer to get that letter. The only letter I got since the interview was one saying my I-751 was approved and that I wouldn't be

issued a green card because my N-400 was approved as well.

I am planning to travel home next year and if I'm still awaiting an oath ceremony date, am I allowed to travel outside the country? My two-year green card has now expired (including the date on the extension letter),

so I'm guessing just travelling with the I-751 approval letter and no green card might be an issue?
