My wife and I just realized we have 21 days left to file the I-751. How are we looking as far as time? Should we be okay if we send it in this week? As long as we don't see it late we aren't violating any rules right even if we don't hear a response before her expiration date of her Green Card? Which is January 31st.

Hi everybody! We went through the K1 process and expecting my now wife's AoS interview in March 2021. Our situation has unfortunately changed and need to stay in our home country for the next 1-2 years after which we plan to settle permanently in the USA. My understanding is that we have two choices: we can either abandon the K1 process (not return to the US before the AP expires on 2/22/2021) and file for an IR-1 in 6 months (when we are 2 years married) or do return, attend the GC interview, and once the GC is in hand, file for a re-entry permit. We are worried that we would have to wait for the biometrics appointment many months which we can not do. Is it possible to leave the USA after the I-131 is filed and return for the biometrics interview? Thank you for all your advice.

So my spouse came on a k1. We married and filled for the AOS. Looking at the processing times for my city it could be 12 to 34 months. If it takes longer then two years would he get a 10 year card? Also, if he would get a 10 year card is there a way to delay the AOS interview if they scheduled it sooner?

So, our I751 has been pending since 12/2018. The last update we received was in January 2020 stating that the case was transferred to the local office. In August, we made an Infopass appointment. We drive 2 hours to the Infopass appointment and they told my husband he could not have a stamp because his N400 interview was scheduled and his I751 would be taken care of the same day. So he went without a license and proof of status for a month. In September, we go to the N400 interview. Everything goes well, but they tell my husband it can't be approved because they don't know where his I751 is and they can't find the documents. They tell him a few more weeks and send him out the door. He comes out and tells me (since I wasn't allowed in) and I obviously freak out that they claim to not have or know where the I751 is. I go up to the door and demand to speak to someone since my name is jointly on these applications, I felt I had the right to be told what was going on. The supervisor comes outside and we discussed the issues in front of literally everyone in line (which I felt was inappropriate). He fed us BS lines that the office processing thousands of applications a day, then he told us our I751 was in Vermont, then he said maybe they'll find it later, then said maybe its at the NBC, and even smugly said "if we determine your marriage legitimate we'll approve it". I was very upset and crying. He could not give any explanation about why they told my husband our I751 was missing. I did a few case inquiries before that stated the I751 was in line for an interview at the local office. We were told it was there a month earlier and well now it suddenly vanished. We literally had to beg for a stamp so that my husband could renew his license and start working a new job being he just graduated and got his nursing license. I can't believe people have to beg for these stamps... Anyway, the stamp expires in October 2021... I was guessing we'll be in this situation for awhile. N400 completion date changed to 01/2021 on the account. Last week I did a case inquiry and the email said the case is "pending decision we can not provide a completion date" at the local office. I feel like they're messing with us. I wrote the senator and got back the same exact thing "pending decision at local office". I don't really know what "pending decision" means, hasn't it been pending a decision since we submitted it? I am just really confused as to why they told us the I751 wasn't at the office, when with every inquiry we're told its at the local office. Are we missing something from the story? Are they just not telling us something? Anyone been in a similar situation before?

Hi,everyone Visa journey and people here was a great help while I was going through my immigration process. I was F2B category. And by this category I was not able to get married until I enter the US and get my green card. It was long 8 years of waiting process. Now I have to start all over again. immigration process for my girlfriend that was left in my home country. As soon as I received my green card and became a permanent resident I flew back to my country and we got married. So now she is F2A category and can qualifiy for CR-1 visa ( which is TEMPORARY banned - I know :(( but still I can apply to USCIC.) Now a tricky question- we were a couple for 20 years but was never officially married (last 8 years because of my visa category). When now I am applying for her I -130 can I show that although officialy I was single we were living as a couple and you could say in a common law marriage??? Will that fact not harm my GC status? Or should I just tell that we lived together only after official marriage certificate ( she had a differnet address)? Also should I show as a proof of our relations that we always traveled on vacation together? Thank you in advance who will share your thoughts. God bless
