US Immigration from Hong Kong

Hi all,

If I am to file a MFJ return to include my foreign spouse's income in my tax return, is she eligible for claiming foreign earned income exclusion (FEIE)? The IRS website said FEIE is only available for those meeting the below criteria. Does she qualify the below when I file MFJ and treat her as if she is a resident alien?

• A U.S. citizen who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year,
• A U.S. resident alien who is a citizen or national of a country with which the United States has an income tax treaty in effect and who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year, or
• A U.S. citizen or a U.S. resident alien who is physically present in a foreign country or countries for at least 330 full days during any period of 12 consecutive months.

Unsure if any of you has filed Form 2555 for FEIE for your spouse before. Grateful if you could share your experience, thanks!

Hi everyone,

Me and my husband have just come back from our AOS interview. The officer didn't say if we are approved right after the interview, she just said we will receive the decision notice through mail.

My questions are:

1. Is this normal? I thought we will know the result right the way.

2. Is she supposed to give us any document or receipt after the interview? such as saying we have completed the interview on xx/xx/xxxx?

Can anyone share your post-AOS interview experience?

HI all, I submitted my I-130 application in April and got the NOA1. I was wondering if I can change my passport on the application? I have 2 valid passports (Hong Kong SAR & British National Overseas). I used the HKSAR passport when filled in the I-130. May I know if its possible to change to another passport at this stage?

May I know if anyone is filing I-130 online from abroad? Do you receive the actual receipt notice by mail? I only got the PDF version from myUSCIS account.
