Uscis updated my case again to actively being reviewed

My us citizen husband filed for my two children under 21 in August of 2021 in January of 2022 we received an online update that they case was actively being reviewed and on September of 2024 we receive a another online update that our case was being actively reviewed we are very frustrated because it s been over 3 years since we filed and still waiting for a response on our I-130 I know this can t be right .

The letter discusses a review of the recipient's immigration status and a decision regarding their admissibility in the United States.

  1. Accrued Unlawful Presence: Initially, the recipient had accrued unlawful presence because their non-immigrant visa expired. However, upon further review, it was found that they had not departed or been removed from the U.S. after their entry on October 16, 2015. This led to a change in their inadmissibility status under INA 212(a)(9)(B)(i)(II). The previous decision from July 25, 2024, is vacated, and the related Form I-601 application is terminated.

  2. N-400 Denial: Despite this, USCIS continues to deny the recipient's N-400 (naturalization) application because they were not lawfully admitted for permanent residence. To qualify for naturalization under Section 316 of the INA, the individual must have been lawfully admitted for permanent residence. The review indicates that they were ineligible for adjustment of status under INA 245(a). Therefore, they remain barred from adjusting their status under INA 245(c).

What can I do to over come this? - I had came here with a visitor visa and stayed where i was granted my green card - never travelled back outside of the US, Now I'm apply for my citizenship and I'm being denied, please help!

I don't normally post, but I just had to come and send a great big THANK YOU to the VJ Community! 7 years ago, I went to see a lawyer to inquire about the K1 Visa process. That lawyer quoted me over $3,000 to help me with the K1 and Adjustment of Status paperwork; I just knew there had to be a way that I could do it on my own.

Well, with some research, I stumbled across Visa Journey and I found the confidence to do this process by myself, by remembering to READ, be HONEST, and TIMELY with all things immigration related. As a result, yesterday marked the end of our journey as my husband took his oath and officially became a United States Citizen.

Though a lot of details aren't needed and you can see our full journey in my signature, here's a recap of our journey, done entirely by ourselves and without paying any money for assistance:

1. K1 Visa filed May 2017

2. Fianc entered the United States June 2018 and we married August 2018

3. Adjustment of Status filed August 2018

4. Green Card issued February 2019

5. Removal of Conditions filed December 2020

6. Permanent Residency Granted January 2022

7. Citizenship Application filed September 2022

8. Citizenship Interview - February 2023

9. Oath Taken - June 2023

At each step of the process, I came here to read the experience of others and join forums of those going through the process at the same time. The members of the VJ community are an invaluable resource and I just wanted to say thank you and to encourage all of you still in the process that there is light at the end of the tunnel. Have faith and patience, and it will happen in its own time.

My husband's greencard application was approved earlier this week. I would now like to start the petition for his 5 year old son. The child does not have a passport. I read somewhere that the passport is not necessary until the NVC stage. Is that true? Or do we need to have his passport in order to file the I-130? Any info you can offer would be helpful. Thanks so much!
