Hello, my husband and I did the CR1 Process in 2017 and were approved in 2019. He entered the USA 2 years after our marriage in Ghana and I was told he would be given a 10 year green card and not a 2 year. However, in 2019 when he came to the USA he only got a 2 year visa so when it was time to renew his green card we did the I-751 form. Well we just got notice From USCIS that our petition I-751 to remove conditions on Residence was denied because he should had been granted the Permanent residence without conditions (IR1) instead of the CR1.
Therefore, we need to file I-90 to receive the 10 year green card without additional fees because of DHS error.
However, when filling out this form I am stuck on Part 3. can anyone who has done this form please help me?
Part 3
1. Location where you applied for Immigrant visa or adjustment of status?
is that talking about Ghana? where I applied for my husband while doing the CR1 or possibly is it asking where the CR1 was processed like the Nebraska filing center? or is it asking me something else?
2.Location where your immigrant visa was issued or USCIS office where you were granted adjustment or status?
would this be the Ghana Embassy where his visa was issued for him to come to the USA? or not?
any help would be highly appreciated since his 2 year visa expires may 2022 and we been waiting over a year now to get this taken care of.
we also paid $630 for the I-751 form since DHS made an error would they refund us that money since he was supposed to get a 10 year and not a 2 year?
and if so how can we reimbursed that money for their error.
