Did I make a mistake? (I129F filed, having buyers remorse vs I130) |

Context: I-129F filed recently, NOA1 2023-01-27. Fiancee and I (the USC) have been engaged since November, only started dating in October 2022 after meeting in person for the first time while she was visiting the states (but knew each other as friends online for years beforehand). Held off on filing I129F until Jan this year so we could accumulate evidence of us spending time together in the US and her home country (total 3 months). We thought about just getting married right away in my home state but opted not to because we felt that the timeline of us going from meeting in-person to marriage would have been a red flag and potentially made our lives harder with having to prove everything. However, now I'm looking at timelines and seeing that CR1 is faster and cheaper of a route and I feel like I made an error with going towards the wrong pathway. Am I correct in this assumption, or would the higher bar of proving legitimate marriage be higher than proving legitimate relationship and intent to marry have been too much of a hurdle?

Hello! My husband and I were married in September 2022 and have submitted our CR-1 application in November. It is unlikely I will get an SSN anytime soon - certainly not before April. We wanted to try Married Filed Jointly for 2022 as I believe it benefits our visa process and yields greater returns. But it's a bit of a hassle to actually do it. Does anyone know a tax filing software which takes the special case of filing a W-7 form for a non-resident alien spouse into account (aka preparing the document without entering an SSN/ITIN for the spouse)? My husband needs to file business and personal taxes and we would like to avoid a CPA and there are hundreds of services out there, perhaps someone in here has experience and can recommend one.

Hello February Crew - I couldn't find a thread for February filers yet, so I created one. I got the reminder letter from USCIS today. My Greencard expires on 5/20. The filing date calculator on the USCIS website is not working for me but I plan on mailing my package on 2/18 (Saturday). At this moment, I am just collecting evidence and printing a lot of documents. I am happy to share the content of my package once I am done. So far, our process has been really smooth (K1 all the way through AOS without any RFE), so fingers crossed that does not change. Here's to waiting.... Again

Hi All, My wife (fiance at the time) arrived in the US in August of 2022 and we got married in September 2022. She also applied for and received her SSN in September as well. She applied for AOS with an NOA1 date of October 10th. We are now filing our tax return for 2022 and ran into a question. We would like to file jointly (MFJ) but it is unclear to us what her current status actually is. From what I've been able to find on here it seems like for tax purposes she might be a Resident Alien, even if by USCIS standards she isn't one. In reading on if this was correct or not, I found several older posts here on VJ stating we had to file the 2022 tax return by mail (was planning on e-filing with TurboTax) and send in some statement asking her to be considered a Resident Alien for the IRS. Is this correct? I'm unsure if it matters or not, but she had no reportable income for 2022, so we don't have additional forms from that angle to file. Happy to provide more clarification if needed, thanks in advance everyone!
