K1 - Intentional Delay

Hello!

I am the US citizen filing for my fianc Caroline who lives in Germany. We have some timeline questions before we file.

The situation is this: We intend to get legally married in the 90 day window next June after we have our ceremony in Germany. That would mean we need the approval no earlier than January. If we file now, and it somehow gets to be approved before years end, could we delay the interview with the embassy at the Foreign beneficiary compiles required forms to send to embassy step? As in, will the appointment for interview only be issued once those forms have been gathered and sent or does she simply have a set timeframe to compile that and send it?

I appreciate any help and guidance on this.

Hi everybody,

I just want to know your opinion on this one. I did send an expedite request on March 10th and got a email back on the 17th saying that due to the COVID-19 they are unable to forward my expedite request.

Did somebody experience the same? Shouldn't they forward the request (because embassies are open for emergency cases)

Thanks for all your replies.

I-485 / 24a.b.c./ J nonimmigrant exchange visitor

Hey there, I am ready to fill out form I-485 and I don t know what to answer on Part 8 General Eligibility and Inadmissibility Grounds, questions 24a.(b. and c.)

Hopefully someone can help me out.
I came over on a J1 Visa as a Au-pair. I ended up pregnant with my first born and married while I was on my J1 Visa back then. Everything was fine and I got my Greencard. Due to my moms cancer diagnosis I ended up leaving the U.S., moved back home to be there for her and abandoned my status.
After 8 years I fell in love with an old friend from my previous town I used to live in the U.S. and just got over on my K1 visa. Trying to fill out the forms and hv trouble answering the specific J visa questions.
24.a. Have you ever been a J nonimmigrant exchange visitor who was subject to the two-year foreign residence requirement?
Do I answer this with yes, since I was an Au-pair starting 10/15/2005 until 09/2006 ( year I got pregnant and got married)

24.b. Have you complied with the foreign residence requirement?
What does that mean? Since I stayed before my Au-pair year was over and got married, then No?

Have you been granted a waiver or has Department of State issued a favorable waiver recommendation letter for you?
Again, I don t really get what they want here. I got married and applied for permanent residence and had before I left to my country the 10-year Greencard. I would answer No then?

Hoping for your guys input, bc I don t get it. LOL

Visa appointment cancelled (Frankfurt)

I have a visa interview scheduled for the coming Monday and just received the following email...

Quote

Dear Applicant,

Please be informed that in light of current circumstances your visa appointment had to be cancelled. We encourage you to monitor our website for information on when you can reschedule.

We apologize for the inconvenience and thank you for your understanding.

Sincerely,
US Visa Service Desk

When checking ustraveldocs.com my interview is still showing as scheduled. No additional information is available online. Obviously it has to do with the President's proclamation but I'm not sure why they are cancelling visa appointments

I sent an email to the IV section at Frankfurt asking for clarification.

Has anyone else had their interview cancelled? Not quite sure how to proceed at this point but this is throwing a serious wrench in our plans.

I-864W or I-485?

USCIS has completed the I-130 petition for our 14 year old son and the National Visa Center has received his approved visa petition from USCIS. The USCIS website states:
NOTE: Form I-485 is now used to collect information previously collected on Form I-864W, Request for Exemption for Intending Immigrant s Affidavit of Support. Adjustment applicants no longer need to file Form I-864W.
However, the Form I-485 instructions state "Form I-485, Application to Register Permanent Residence or Adjust Status, is used by a person in the United States to apply for lawful permanent resident status.
As our son resides in Germany with us and is not in the U.S., IS i-485 the right form to file? If not, does anyone know the correct form to use?
