Hi,

I was wondering for the proof of support:

My fianc e only worked 5 months in 2019 (obviously the 16.9k are not met)

Since mid-November she is working again.

Are the months worked on 2020 counted?

Good evening everyone, I need help on my friends case for the I 130. Her case was denied because insufficient evidence of information that was submitted by a place where she filed her case. She doesn't speak English so she trusted a place where they did immigration papers and all of the sudden she got denied. She has 30 days to appeal, well now 18 days to appeal. Should she find a lawyer to help her fix the situation or just reapply for another I 130 for her husband again with the right information. She doesn't have much money to spend on a lawyer but if it is a must to save her application for her husband, she will borrow. But the whole thing on these papers were incomplete because the filer forgot to put important information and she translated them incorrectly to the actual documents. So that is the case that the I 130 was denied. Should she file again for the I 130 or see a lawyer to fix her case and what kind of guarantee does she have that he will get approved if she pays all that money to the lawyer. Your help is truly appreciated. Thank you.

Why some K1 processes are super fast?

Hello everyone,

I was checking the timeline for the K1 visas on this website, and I noticed that for some cases it takes something like 150 days and for some other cases it can take around 400 days (I-129f -> interview).

I was wondering what are the main reasons for a case to be that fast or that long?

Hello all, the last 24 hours have really left my head spinning and my blood pressure at an all time high learning all of this information about immigration to the US. I'll try not to drag this post out for too long, and not ramble too much.

I myself am a US Citizen (21M) and I'm posting on behalf of my French fianc e (20F) to hopefully find some answers.

I have been living in France with her for three months under a Schengen visa, and in two weeks we will both be going to Quebec, Canada for at least 4 months and possibly up to 6, for her final internship to obtain her professional license. After that is currently unknown, and the reason why I am here.

I was under the very misinformed impression just getting married would be enough to keep her in the USA, but I've now learned it's nothing close to that and that we have a very complicated and annoying road of paperwork ahead of us.

After talking to some people on reddit, three possibilities were proposed to me, and none of them seem great so I'm here to ask for some help.

We plan to get legally married the first week of March, then she will leave the country and remain in Canada throughout her internship, and this is when we would like to begin working on the proper visa. After some reading about the CR-1 visa, it seems near impossible due to the financial affidavit. I simply don't make enough money at the moment to meet the 200% annual income over the poverty line. At the time of writing, I don't even have a job in the States, I am actively looking for one near the border. My family's financial situation isn't very good either, and her family wants us to be able to do this without help.

Someone mentioned something called the VIE program where she comes in under a J Visa and works for a certain amount of time, anywhere from 6 to 24 months, and we can apply for an AOS during that period, but I'm still very confused on the whole process and how long all of this takes.

We would like to avoid being separated at all possible costs, seeing as both of our living situations at the moment greatly depend on each other, mine even more so than hers. We would prefer to live in the US for the next few years, and it doesn't seem that France is any easier for us to get married and immigrate to so I'm not sure if that's an option either.

I would appreciate any advice from you all on what we should do.

i-134, Fresh divorce and no W-2

Hi,

Let me explain the context: my fianc e got divorced last year and before that she was a stay at home mom. We sent our i-129f early:mid-januay, she had no job so we just left the Employment information (N/A to be accurate).

Since then she found a job so we're not worried about the income requirement. But we started watching the requirement for the i-134 and we see a lot of people saying that we might need Form W--2. But because she was not working before, she doesn't any.

I can't seem to find if it's a requirement or not, the instructions of the form says :

Quote

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details
regarding the account:
- (1) Date account opened;
- (2) Total amount deposited for the past year; and
- (3) Present balance.
B. Statement(s) from your employer on business stationery showing:
- (1) Date and nature of employment;
- (2) Salary paid; and
- (3) Whether the position is temporary or permanent.

C. If self-employed:
- (1) Copy of last income tax return filed; or
- (2) Report of commercial rating concern.
D. List containing serial numbers and denominations of bonds and name of record owner(s).

Can you help figuring out what's if that's a requirement, and if there's anything we can do if it is ?
