Hi Everyone !


I filed for AOS in June 4th 2020 along with EAD and AP applications. I finally got my biometrics taken on December 3rd, so far there was no updates on either applications but yesterday my case updated to interview scheduled. No updates of approval for EAD and AP though.. I am confused on how they are processing things I guess , I thought for sure I would receive the EAD card first but it seems like it might be the green card first . Has this happened to anyone ? Do they know not to send you the EAD in that case ?
I am not complaining , just surprised ! :)

Hi everyone . Quick question about the petitioner.
the process will go faster if you are Citizen ? I always heard that but
i saw on the uscis that the processing time for the spousal visa (i-130) is approximately the same as for a citizen.

Can you confirm ?
My fiance is a LPR and was in process for the citizenship but he miss his interview month ago as he was stuck outside the us and no he was waiting for month for us is to Schedule an appointment

But because of some issues in his case (did not send a paper they required once he miss his appointment) they tell him that his case in under review and either they are gonna close it and he will have to apply again either they will give him an appointment but it s gonna take time dir to COVID .. we first wanted to wait till he become a citizen but we waist many time and we are thinking about filing for i-130 now even if he is a citizen and just wz t

To know if it is gonna take much more time than if he was citizen.

EAD Approved but still no card. Any ideas?

We submitted my wife's AOS paperwork with EAD and Travel Permission earlier this year and was received by USCIS on May 4, 2020. We received her approval for work and travel on September 25, 2020. Normally the EAD card prints shortly after approval (most get it within 2 weeks) and you receive it but we got nothing. We have called USCIS multiple times, opened inquiries, submitted e-status request, have contacted Ombudsman's Office, and also contacted our senator's office. Everything we are told is there are delays from COVID but many have submitted after us, been approved, and have gotten their cards. Its insane we have waited months just for the thing to be printed and mailed.

We did notice a weird issue that may have caused it relating to the biometrics. Technically you do not need your biometrics taken for the EAD it often is done before and we think a trigger for their process work flow. However, my wife has not had her biometrics done yet. We have also requested this appointment multiple times with no resolution.

USCIS due to these delays had a class action lawsuit where they allow those that received the approval letter to work, but only those approved before August 20, 2020. So we just missed this. We have also requested from all parties is there any way they can just extend this letter since delays continue.

We are at a complete loss on what to do. She started applying for jobs, got 2 offers she had to refuse, and booked an emergency trip back to France she had to cancel all because we thought this would come in the mail much sooner. It is not a mailed or lost card as the status online has changed from Approved. She just got another job offer, a very good one that would start the end of this month and we are trying to find some way to make this happen.

Hello,

I'm french and currently have a 2 year conditional green card based on marriage. It will expire on next March 1st. My wife and I are going to leave the USA and move to France in February. Do I have to fill a I-407 form or just let my green card expire without more notification ?

My concern is : will I be able to come back to the US for visiting (less than 90 days) with an ESTA ?

How to show current income of Form I-944

Hi guys!

I am filing the form I-944 and I find it very complicated compared to I-130 and I-485.

The questions are asking about the income earned during the previous years, backed-up by tax returns.

My wife never filed a tax return as she was under the threshold (I indicated that).

She now makes well above the 125% of the Poverty Guidelines.

I don't see anywhere on the I-944 form where I could write down her current income and explain the situation.

Should we write a letter explaining it on the separate page, or even use the Part.9 additional information if we have enough space on there?
