Hello Everyone,

I hope you all are doing well as we are all in this long journey together. I was hoping you can answer my question or dilemma. I will explain the situation clearly so that you have all the info in order to respond.

I have known my boyfriend for 2.5 years now. He is a refugee in France. He has his temporary french residency card but it will take at minimum 6 months for him to get his permanent residence card. Only then can he apply for a french travel document. His current country passport is expired already :( In order for me to reduce the amount of waiting and being apart, I was thinking that I should apply for the i130 and get that part started at the 6 month mark of when he may get his permanent residency card and travel document. This would mean I apply for the i130 without a passport number or travel document number which I believe is fine to do at the USCIS stage. I believe I read that at the NVC stage is when a passport number or travel document number is needed.

So here are my questions:

1. Can I indeed start the i130 without the passport number or travel document number?

2. After how many months on average would I need to wait in order to then provide the passport number or travel document number?

3. If by the time I need to provide the passport number of travel document number, let's say I don't have the passport yet and its still in processing, would NVC put his case on hold till they get that or will they deny and we have to start all over again?

Again my goal here is to reduce wait time and being apart so I was just trying to see if I can time things correctly so everything can align :) Thank you all so much.

Hello,

So I have my interview in a month for a K-1 Visa.

So my fianc e doesn't meet the required money (by very close unluckily) but her dad is co-sponsoring us. We did the papers (I got them today through mail) but I think we messed up for her dad we filled the I-864 instead of an I-134 (we thought only the fianc had to do this form).

Can someone confirm or unconfirm that both sponsors have to do a I-134? It's pretty confusing online :(

Apparently the 864 is maybe for the "previous" AOS that Biden cancelled, etc...

Thank you !

Importing household goods while AOS pending?

Hello everyone,

I have a tricky question and no one seems to be able to give me an answer (neither my lawyer, my relocation company or even the CBP Q&A website).

I filed AOS from VWP (ESTA) on February 3rd 2021, after marrying my US Citizen husband. I haven t received the Notice of Receipt from USCIS (hopefully will get it within a couple of weeks now).

I would like to bring my personal effects/household goods from my previous home in France here to the US (where I now live). My question is: since I have no status until I ll get my green card, am I allowed to import my belongings? If yes, what document is acceptable to the US Customs to prove I am legally present in the US? (Will the Receipt notice of our I-485 be enough, or should I wait to receive my EAD at least, hence obtaining an SSN?)...

My relocation company says I can simply import them under my husband s name, but I m not so sure about this as he never lived with me in France and those goods were not yet technically part of the family household as I acquired them before we got married.

Beside, my passeport is still in my maiden name (I don t yet have any US ID with my married name on it, I only have our certified marriage certificate) but the Receipt Notice will be in my married name, and the relocation company says that it could create issues at Customs.

I wanna make sure to do the right thing here, and If this means I cannot import my belongings until I obtain my green card then so be it, I just need to know IF or WHEN will I be allowed to import them.

FYI, I emailed CBP and asked them the question. They said the question needs to be asked to the Port of Entry Customs team. I told my relocation company to contact them but they seem to only talk with their Customs Broker agent, not the CBP directly. This question has remained unsolved for 3 weeks now, I cannot find any answer to this specific situation anywhere on internet, I m desperate to understand what I can or cannot do about this import.

Has anyone been in the same situation and can advise me?...

Thanks

I've seen this everywhere about people posting having their status changes to AP after the interview. Basically we had our interview last week wednesday at Paris Embassy (before you ask we are milligan plantiffs), this week our status online went from Ready to Administrative Processing. I know alot of folks who say it will turn into Issued after... I guess my question is this.

Is it faster to have them ship it to our house or to pick it up at the Paris lock box. Is the Paris Lock box open on Saturdays? Did anyone else who interview in Paris have their status changed to AP and then issued, if so how many days after did you receive your passport?

We are trying to figure out if he will likely get his passport for the weekend. So that he can travel this weekend.
