So I am working on my wife's 1-944. I am making sure I am answering each question carefully....The number of individuals in the household which should include stepchildren. I am assuming I add MY 3 kids because they are legally her stepchildren, BUT she has no financial responsibility over them as they are shared between my ex and I. Am I on the right train of thought here? Thanks.

Part 2. Family Status (Your Household) USCIS will review your family status as a factor in the public charge inadmissibility determination, which includes an assessment of your household, as defined in 8 CFR 212.21(d). The term child includes stepchildren and adopted children, as provided in INA section 101(b)(1). Item Number 1. Household.

The following individuals are part of your household: 1. If you are 21 years of age or older, or under the age of 21 and married, list the following household members in Part 2., as applicable:

A. You;

B. Your spouse, if physically residing with you;

C. Your children (under the age of 21 and unmarried) physically residing with you;

D. Your other children (under the age of 21 and unmarried) not physically residing with you for whom you provide or are required to provide at least 50 percent of financial support, as evidenced by a child support order or agreement, a custody order or agreement, or any other order or agreement specifying the amount of financial support to be provided by you;

E. Any other individuals (including a spouse not physically residing with you) to whom you provide, or are required to provide, at least 50 percent of the individual s financial support, or who are listed as a dependent on your federal income tax return; and

F. Any individual who provides to you at least 50 percent of your financial support, or who lists you as a dependent on his or her federal income tax return.

I864 and I944

So I am just started filling out my spouse's 1485 packet and came across the information regarding the I944. So the I864 is regarding MY ability to help support her, correct? And the I944 is a newer form for this process and it will show her financial situation from back in Finland, correct? I am a little overwhelmed to say the least....as this seems incredibly daunting. Do we need to get her banking and tax forms from back in Finland? Any advice would be appreciated.

Including WhatsApp etc messages?

Hi guys,

we are in the process of submitting the i-130 online and doing the consular processing since my husband lives in the States and I'm still in Finland. I've read a lot of posts about couples including WhatsApp/Facebook/Skype/email messages as supporting evidence in their i-130s. How necessary is this? My husband and I first met back in 2014 and basically we've been talking daily on WhatsApp ever since. So, you can imagine the amount of conversation/msgs and there is no way we can start putting that into PDFs.

Since we've never lived together we obviously have no joint leases, joint bank accounts, credit cards or any of that yet. What we have, on the other hand, is lots of selfies/photos of us over the course of five to six years (planning on using phone screen shots so the time stamp of each photo is visible), affidavits, passport stamps of visits, a few hotel reservation bills, wedding pics and life insurance policies, where we are marked as each other's beneficiaries.

Would you still try to add some online conversations (it would be hard though due to the massive amount...) or do you think we are good without?

filing i-130 online if petitioner in the US

Hi everyone,

this is probably a dumb question, but can you file i-130 online even if the petitioner, my husband in this case, resides in the US? Im asking because in the USCIS page it states that the filing location for a form I-130 depends on where the petitioner lives:

  • "If you reside in the United States, file at the Chicago, Dallas, or Phoenix Lockbox, depending on where you live and whether your relative is also concurrently filing Form I-485, Application to Register Permanent Residence or Adjust Status. For a complete list of addresses, visit our Direct Filing Addresses for Form I-130 webpage;
  • If you reside outside of the United States, you may:
    • File at the USCIS Dallas Lockbox facility;
    • File online using the USCIS website; or ...."

Based on the above it would seem online filing for petitioners in the US would not be available, but surely that is not the case, right?

Round trip vs one-way

My fiancee is going to fly in from Finland in about 6 weeks on her K1 Visa. Is it ok to buy a round trip ticket, due to it being much cheaper, or does that spark negative attention from passport control at the POE? Thanks
