We haven't quite finished, or I guess are not even close (ha), the K1 process as we are still in the NOA1 stage (hopefully end). But as far as our next steps, current events, seeking similar situations, etc. I've been trying to stay abreast and hopeful with everything that is going on. I've been reading some other posts here and am starting to worry that I/we messed something up along the way, so I'm looking for some input before we potentially jeopardize future immigration;

  • Fiance and I have always been living apart in 2 countries. We've met and hung out on a few occasions, but due to my job, vacation time is few and far between. We've made it work.
  • The plan was to obtain the K1, marry in the US, he stay for maybe 2-3 weeks (max), he return home to Finland and we file for the CR1.

My question boils down to: Did we mess up? Due to our situation financially, and the aforementioned vacation time, there's no way he can stay for the 90 days of allowed K1 time. I understood the process that once the K1 is used, it becomes dead and you are responsible for beginning a new process for immigration. Is the Adjustment of Status the only route to immigration with this visa, and is Advance Parole the only way to leave the US and not jeopardize our future? Or can this visa be used and he leave in the time frame we specified above, and then we file for the CR1?

Good Morning!

I just wanted to start by saying how grateful I am that everyone here is so helpful and wonderful. I am working on the 129F form and have a couple of quick questions. My Finnish partner has a couple of quirky things that make answering some of these questions hard.

1. Part 2. Q 1. pg 4. Beneficiary Middle Name- My partner is Finnish and they have this 'third name" thing. Do I just put his middle name and third name on that line?

2. Part 2. Q 12 pg 5. Beneficiary Address History- My partner has an address now but had some rocky times in the last 5 years resulting in him couch surfing. I guess the question is how do you document that or should I use his parents address?

3. Part 2. Q 16 pg 5 Beneficiary Employment History- Same thing here, there is some unemployment history. Should I just put Unemployed in the employer name to cover each time period?

4. Part 2. Q 24 pg 6 Information About Your Beneficiary's Parents- Ok this is the tough one. Sasu (my partner) was born in Russia where he lived in an orphanage for the first 6 years of his life. He was adopted by a Finnish family when he was 6, who he ultimately ended up hating and running away from. When he was like 14 he was taken in by another family and these are the people he refers to as Mom and Dad. Foster parents I would assume.That is who we put on his ESTA paperwork when we did that. So for this question what should I put? He has no information about his biological parents, he knows first and last name of his adoptive parents but wouldn't know middle name and may or may not know birthdays for them. He can probably guess at the place of residence. Just not sure who he should be putting in this question. Sorry for the lengthy question and information.

5. Part 2 Q 38 - Since Sasu isn't currently here in the US, do I just leave 38a-h blank or put N/A?

Hi All,

I am getting ready to start my journey with my partner who is a Finnish citizen. We are going to go the K-1 route as it gives us ample time before marrying. We met playing video games in September of 2019 (I know, silly) and I have adored him since. I am a USC and well established here in the US so we feel that him coming here is the best option. Just trying to figure out if I need to hire an immigration lawyer or if this is all straight forward enough that I can sort it myself. Looking for the pros and cons of each.

We received are hard copies of our receipts in May 10, but still haven't heard about our biometrics appt? We are located in Phoenix, where Covid is surging right now, and that could be the only reason. Anyone else still waiting for their biometrics appt?
