Hello again, we're doing AOS based on a K1 visa. On the I-485 Part 2. Number 13. it asks: "Priority Date from Underlying Petition (if any)" Above that it asks for the case number, I put the WAC number in that box. For the priority date, I'm looking at both our NOA1 and NOA2 and cannot for the life of me see a priority date. There is nothing on the NOA1. On the NOA2 I see a box that says "priority date" but it is empty. Should I leave the priority date box blank on the I-485? Thank you.

We're almost ready to submit documents for AOS finally. The I-94 has expired and so has the K1 visa. On the I-485, Part 1. Question 24. it asks: "What is your current immigration status (if it has changed since your arrival)?" What should we put? I've seen very conflicting information online about this. The example form on here leaves it blank, should we? Has our status changed? Thanks so much.

Soooooo, I got the dreaded RFE today.... here are my thoughts... So I make over the required 125% poverty guideline. When I submitted the Affidavit of Support, I included my 2019 tax transcript (2020 T.T not included because it s not up on the IRS website but I have filled) W2, and verification of employment (letter from HR). I couldn t include pay-stubs because at the time I did not have access to my work s online pay system. I wasn t too worried because pay stubs aren t typically required but I know they can only help my case. Now I am worried because I can no longer access my pay stubs because my company switched online pay systems that allow us to view/print paystubs and the site is inaccessible to me now. I was thinking of including bank statements as that s all I have to prove that I m getting consistently paid. The RFE I got was vague which is so frustrating because it gives me no direction to go in. So I feel like I m only speculating at the mistake I made. Shouldn t the tax transcript be enough to proof that I can support my husband? I also went back to check on my copy of the Affidavit of Support and noticed a potential error I made. Under part 5, where it asks for household size, my print out, which was directly from USCIS was auto-populated to 1 and I never manually fixed it to 2 because it is just my husband and I? I figured if it was already there, why change it? Has anyone encountered this? And to make matters worse, my husbands last name is still spelled incorrectly even though we ve already sent a request online to have it fixed 3 weeks ago. Sorry for the wall of text. Anyone have any thoughts or advice?

Hi all. Just want a little advice. We are looking to file our I-129f soon but have questions about being able to visit and numbers 38a - h on the form. We are a little blown away by being able to/not being able to visit so we were thinking of waiting until I m in the country to file the visa and knock 2 months out of the way. My first question is, if we file it while the beneficiary is in the US visiting with an ESTA, do we tick the box on the form that says is your beneficiary currently in the United States 38a - h. It also asks for a I-94 departure-arrival record number. How would we find that if we were currently in the US visiting when filing the I-129f? Also, we have visited each other in US & UK for months at a time on at least 8-12 occasions. Will this be a negative when trying to enter the United States as a visitor while the K1 visa is in process. We are just looking to keep the time away to a minimum and don t want to risk anything jeopardising the approval if it s that easy to get denied when visiting in the process

Hi Everyone, Hope you and your loved ones are healthy physically and mentally in such challenging times. I'd appreciate your help with a quick question: Am I allowed to apply to ANY USCIS office? I ask because the one nearest (15 mins), completion date is expected to be 18-28 months. Whereas, if I drive about 2 hours to upstate, it goes down to 7-14 months, or even about 45 minutes away, it's 9.5-17, both of which are way better scenarios. I'm applying under the 5 years rule (even though I'm married), and applying online, so I don't have to be to the actual office too often, that the drive would be an issue, right? or is there a rule that pending my zip code I'm designated a certain office? (and if so, how do I find out which ones I'm allowed to?) Thanks for your guidance! Be safe :)
