No one has made an April post yet. We re planning on filing next week. Good luck to everyone here. Double check the dates on all forms and make sure you follow the new requirements since they changed as of February 24, 2020.


AOS Checklist

  • Cover Letter listing Table of Contents
  • (Check Payable to U.S. Department of Homeland Security - $1,225.00)

Form I-485 (completed and signed by non-US Citizen/beneficiary)

  • Form G-1145
  • Form I-944 (Declaration of Self-Sufficiency) (required as of February 24, 2020)
  • Copy of beneficiary's Passport with biographical page
  • Copy of beneficiary's K1 Visa from Passport and entry stamp
  • Copy of NOA2 Approval letter (from K1 process)
  • I-94
  • Copy of beneficiary's Birth Certificate
  • translation of birth certificate (if needed)
  • Certified copy of Marriage License
  • Passport Photos (2) name written on the back
  • Copy of DS-3025

Form I-864 (completed and signed by USC) (goes with form I-485)

  • Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other)
  • 2018, 2017 (optional), and 2016 (optional) Tax Return (with W-2) or Transcripts
  • Employment Verification letter (updated one - not the one used during K1 process)
  • Paystubs (last 3 months)

Form I-765 (completed and signed by non-US Citizen/beneficiary)

  • Copy of beneficiary's Passport with biographical page
  • Copy of beneficiary's K1 Visa from Passport and entry stamp
  • I-94

I-485 Question About Proof of Foreign Employment

I'm currently getting the AOS packet organized for my wife with the new requirements after getting rejected for using the old forms. I'm confused about the requirements on the employment section. The instructions say to include the last five years of employment, both in and outside the United States. But there's this section in the instructions that has me confused.

"For applicants subject to the public charge ground of inadmissibility under INA section 212(a)(4) only, provide evidence for the last three years of employment such as federal income tax transcripts from the United States Internal Revenue Service (IRS) of the person s IRS Form 1040, U.S. Individual Income Tax Return; or if not required to file federal income taxes the most recent IRS Form W-2, Wage and Tax Statement, if applicable."

This section is requiring proof of employment but I'm confused if that's just proof of employment in the US or also foreign as well. My wife had a job in Ecuador before coming to the US last year working on a short term construction project for a few months; just simple labor and bricklaying. She made very little money (only about $250). The problem is that she has no evidence of work and was paid in cash since that is how a lot of jobs are done in her country. What other evidence could be sent in? Should I even bother including this job on the form? She hasn't had any other job in the last five years due to being on a missionary/volunteer trip during that time. Has anyone else been in this situation or could offer some suggestions?

Processing of I130 delayed because of coronavirus?

The estimate for my I-130 approval from Visa Journey has fluctuated from February 15th to March 30th with last weeks estimate being March 27th. Then today I received an estimate of August 3rd. Has the USCIS quit processing applications because of the coronavirus? How does an estimate go from less than 2 weeks to 5 months down the road?

I'm having a bit of a freak out over here. My husband is currently on an I-551 stamp that expires on April 27th, 2020 (as he's waiting for his I-751 to be processed and green card to be in hand). We live in the Seattle area and already the USCIS office has been closed down for two weeks due to an employee testing positive for COVID19. All of the schools in our area are closed until at least April 27th, 2020, so I'm suspecting USCIS will follow suit. I'm trying to be a bit proactive here and am wondering what he should do if the USCIS office is not open to renew his I-551 card before it expires? His I-751 application was submitted in September of 2017. It was moved to NBC sometime in 2018. We have not heard anything since. If his I-551 stamp expires, he cannot work. We called USCIS today and they told us we could contact NBC by mail (not email or through phone), is this really our only option? Is there anyone in a similar situation? And what can we do? Any suggestions?
