Hi,

Does anyone know if you have to file taxes this year to complete the I-864? I am looking at it now and it doesn t seem so but I just wanted to know if anyone knew definitively?

Hello,

Our K1 visa was received in Texas right around November 4, 2020. We are planning for an August 28th wedding. Found location, did guest list etc...but as I keep watching YouTube, I am starting to worry about the timeline.

What are the opinions on moving the date?

Hi, in an effort to try to give you a little bit of a point of reference by using our current data and data provided earlier in an earlier thread we have made an educated guess that 7 months from date NVC accepts your paperwork is when you will be notified for your appointment. We were notified on February 9th of our scheduled visa appointment which is March 30th, 2021 so it takes an additional 2 months before actually attending it.

Excerpt from our timeline:

Taking an excerpt of information posted by JKLSemicolon, where he pointed out with the following actual data:

"Right now the U.S. Embassy/Consulate in Ecuador mentions that CR-1/IR-1 visas are being processed in Guayaquil, and have been since August. I was visiting in Ecuador when the state of emergency was announced in December but I thought it was quickly rescinded and I wasn't able to find any reference to this when it came to visa processing at the Consulate.

I have been checking the monthly immigrant visa issuance statistics from the Department of State and will list the total number of CR-1+IR-1 visas issued by month in Guayaquil since the beginning of last year. Since interviews are required for these visas, this the best proxy that I know of for judging what is happening there:

  • January 2020: 101 visas
  • February 2020: 77 visas
  • March 2020: 36 visas
  • April 2020: 5 visas
  • May 2020: 2 visas
  • June 2020: 7 visas
  • July 2020: 21 visas
  • August 2020: 51 visas
  • September 2020: 58 visas
  • October 2020: 70 visas
  • November 2020: 44 visas
  • December 2020: 71 visas

It appears that the slowdown added 5 months to the total wait time after analyzing the previous data. Prior to COVID-19 processing times had expectantly been about 30 days of a delay between when NVC accepted documents and when the Consulate in Ecuador was then contacting beneficiaries for an appointment at the Consulate. This usually had meant another 30 days at least before going to the appointment or two months delay from when NVC accepted your documents to when you went for the interview. If this 2 months was still the norm when we finished filing on practically the beginning of August we would have had an appointment as soon as October.

Now lets examine the fact that we got notified of an appointment towards the beginning of February for a date of March 30th which is basically April. We can then take notice that from October to April this is actually a 7 month delay on top what was normally expected to be 2 months from when documents were accepted by NVC. This is a total of 9 months. Actual data from our timeline shows we finished paperwork at beginning of August, rounding up. From August to February this is 7 months. Lets add the difference of time I explained earlier from being notified of appointment to actual appointment date and that is an additional 2 more months (February to April). This is a total of a 9 month delay of time from when your paperwork is accepted by the NVC and you actually going in for the interview at the Consulate in Guayaquil. This is just an estimate but the best that you can go by using current data and from our dates as a point of reference.

TL/DR: By my estimates it will be 9 months from the date NVC accepts your documents to the time when you will walk in for your interview.

Filing taxes after K1, during AOS

Hey all.

My wife came here with a K1 visa in April and we married in July. She filed AOS in late September and we are waiting EAD and AP (still haven't heard about biometrics).

Anyway, I filed our taxes today with TurboTax. Married filing jointly. My wife has a SS number from back when she lived here in 2007-08, when she worked during her study abroad in college. I used her SS# and filed just as if she was a US citizen because I didn't know any better. I didn't see any questions about citizenship, residency, or foreign income - though it's possible I overlooked something about foreign income. It seems like TurboTax doesn't enter that line of questioning.

I e-filed my return just to come on VJ and learn that you both should sign a statement saying you wish for your spouse to be treated as a resident for tax purposes - and that you report foreign income. I have no problem doing either of those things - but I've already e-filed. Turns out the IRS isn't accepting returns until February 12 so it's waiting in the queue until then.

If my return is accepted by the IRS, what is my next step? I suppose I can amend the return to include the foreign income (it's not much) but it's hard to e-file an explanation letter. I have seen others on VJ say they e-filed no problem in this situation, so I wonder what I should do if it's accepted.

If it's rejected, I know to file by mail with the letter - pretty straightforward.

I just want to be ready :)

Venezuela Passport Rejected by NVC

My husbands Venezuelan passport was rejected by the NVC review officer for being "expired." However, according to the State Department website they are accepting expired Venezuelan passports for an additional 5 years past the date printed on the passport. It expired last year. Thus, there should be a little less than five years of validity according to their website. Additionally, he has an extension in the passport that is good for another year. Both the passport and the extension were submitted to NVC.
