Hi all, my husband received an RFE for his I-485 for marriage proof. We submitted our response online on 6/25/2023. 60 days have gone by and nothing. We sent an inquiry online on 8/26. How long should we expect to get a response? Thanks much!

Hi all,

In 2014 I got married in the USA on a K-1 visa. I got the 2-year green card after this, but in 2017 we relocated to Canada (where I am from) before I got the 10 year, so was unable to renew as we had taken up residence in Canada.

Now we would like to return to live in the USA. We have filled out and submitted the I-130.

1) Is there any part of the process that is made easier or will be skipped as I was already thoroughly vetted the last time and previously held a green card?

2) Once the I-130 is approved, is that when I can take up residence and apply for the adjustment of status with the I-485? Am I able to move to the USA before this and add my I-485 as a concurrent filing? I'm confused by the fact that those that entered the country legally can file both concurrently, when we thought I needed permission through the I-130 to move there in the first place. Are people just entering as visitors and then staying and applying?

Thanks for any help with these questions! I still find these processes difficult to figure out and navigate, despite the fact that we did it successfully once before.

Missing Medical during Marriage petition interview - next steps?

Hi everyone,
I'm living in the US and married to a US citizen and applied for a marriage petition (I130) and permanent residency (I485) in April 2022. My work authorization was approved last year and we received notice of our interview a week before the interview date. We went to the interview a month ago and it went well, my I130 was approved right away however since I didn't have my medical (I693) complete, they couldn't finalize my application. I'm in the process of finishing my medical on my end however I was under the impression that I should be waiting for an official RFE prior to submitting any additional information on my case. I received a courtesy notice letter for my I693 last year but was pregnant then and couldn't do some of the required immunizations but never received an RFE for it. Once I'm done my medical - which I'm expecting should be done in the next week, should I submit it (my I693) or wait for an RFE?

To date, my file still says "Case is being actively reviewed by USCIS - nothing is outstanding at this time".

I know I dropped the ball by not having my I693 in time for the interview, I was thinking I'd get at least 2-3 weeks notice before the interview date. I just don't want to wait in limbo and not sure what the next steps are.

Supporting documents required for spouse of joint sponsor?

Hi all,

My interview is coming up in a few weeks and we are gathering all the required documents. My mother-in-law is our joint sponsor and since she is married, we are aware that my father-in-law needs to fill out an i-864a to be brought to the interview. I'm trying to find out if we need to bring the same supporting documents for him as was required for the joint sponsor. On the CEAC portal, we submitted her proof of citizenship, domicile, tax returns, W2 forms, as well as pay stubs and an employment letter. On the travel.state.gov website it states we are required to bring a photocopy of her proof of legal status and most recent federal tax return to the interview, but does not mention the supporting documents requirements for her spouse, if any. Do we need to bring proof of his legal status and his most recent tax return in addition to his i-864a as well? Would any further documents be required, such as proof of income? If so, what documents would satisfy this requirement, given that is he retired?

If anyone has any information or advice on this, it would be super helpful and greatly appreciated!

Hello!

I have my medical appointment in less than a month and I am confused about the hep B requirement. The instructions from the immigration doctor for my age group require "2, 3, or 4 doses depending on vaccine or condition. A partial series is acceptable as long as the next injection in the series is not due at the time."

I am confused on if I should get a hep b vaccination from my family doctor ASAP or not. I had 1 hep B vaccination in 2005 and I don't know if that counts for anything as it is so old. Is it best to go to my family doctor and get a hep b vaccine, or should I wail until I see the immigration doctor? I am worried about the timing of the doses and getting vaccinated too early or too late.

Any insight would be greatly appreciated.
