US Immigration from Canada

Hi all,

Here is our situation:

• Beneficiary entered on K1 Visa in 2019
• Married in US in 2019
• Beneficiary stayed for over 200 days in US in 2019 (meets substantial presence test)
• US petitioner makes all income
• Beneficiary makes zero income
• AOS was just filed and is pending

We need to file as "Married Filing Jointly". It sounds like we need to file via mail with form 1040 and a statement that says to treat beneficiary as a US resident for tax purposes in 2019. We also need to get a SSN before filing (having trouble with local social security office for months).

Am I missing anything here?

Hi Everyone,

Filling out the I130 online, it is asking if my spouse has EVER been in the US. When putting yes (as she visited me often from Canada before we moved to Canada), it prompts me to enter the beneficiarys class of admission and information on it which she didn't have, as a Canadian she would just visit. There is no drop down option for visitor, or Visa Waiver, or nothing.

Since its all in Caps asking EVER, I'm assuming that this means even to visit.

so I understand my wife being the primary sponsor is required to fill out the I-864 and her mom being our co sponsor is required to fill out an AOS aswell although we will be using her home as our domicile in the states aswell so I m just curious does she fill out the i-864 or I-864a?

Hello. I applied and CC documents qualified on Oct. 26 2019 and still waiting for scheduling for interview.

I discussed my lawyer, she said NVC doesn t respond any inquiries. Even phone calls. Anyone knows?

Hello all I was searching around the forum the last few days and can t seem to clarify my question so I thought I would ask. I hope I have got this in the regional forum.

I know I am to request the privacy act criminal record check. Now I have had two names my maiden (which I have also switched back to) and my previous married name.
when I go into the detachment do I have to request two separate ones or do they run them both on one report? I am assuming I will have to have both legal names run through for this police check.
