Question about the Two-Year Residency Requirement? |

Hi everyone, me and my fiance are currently in the process of the K1 visa and got our NOA2 approval in April. We are now waiting for the Montreal embassy to reopen for interviews. My fiance previously stayed in the US for 3 months at on a J1 visa university exchange program back in fall 2018. He paid tuition fees directly to his host university. We are unsure if the 2 year Home Residency Requirement applies to him. Since he is a Canadian citizen, they do not get the J1 form on their passport because Border Patrol takes it. His DS-2019 has a program number that starts with P, it also says he got all his funding from personal funds, and it doesn't have a checkmark in the area where they tell you if you are subject or not. Would the fact that his DS-2019 says personal funds be proof enough that he isn't subject to the 2 year rule? If we seek an advisory opinion, is this all they look at - the DS-2019 form? How else would they know what type of funds he used? If it does end up that he is subject to the 2 year rule, when would we find out? During the interview or the Adjustment of Status phase? Please help as this is really worrying me. Thank you.

Hi there, I was wondering if someone could answer this question for me, I think it's going to sound pretty dumb but here goes. My Fianc has moved to NYC on a TN visa and I am now trying to join her and we are looking at different options. I was wondering if it would be possible for her to change her TN visa to a L1 as she was transferred from the UK to NYC and I could be listed as a dependent. Our goal is the ability for the both of us to work and I own my own business in the UK which I am going to expand to the US as result of this move. Alternatively, I was looking at the E2 visa for my self and I hold both a Canadian and British passport. Thanks in advance, Stas

Waiting (patiently) for my oath ceremony that was cancelled due to COVID in New Orleans. Crickets out here. I sent an email because my I551 stamp is expiring and I will have no proof of status for my employer but all I got was the canned response about "COVID, increased wait times, wait 90 days, etc". Any other Big Easy-ers waiting with me? Heard anything?

Hi guys, This may seem like a really basic question. We are going to be getting married 3 months from now after which I'll apply for AOS. When should I start preparing the forms and obtaining documents? Should I wait until a month out or can I start now? My only thought was if the information I am providing is 3 months old then I may have issues, such as my credit report for form I-944. Thanks!

I have a query. Commissionaire-North Alberta office refused to book an appointment for criminal check record for my 16 yrs old daughter. They are not doing it for minors under 18. Has anybody experienced a similar situation?
