I know it s probably a long shot to get an interview this year, nobody has anymore information then I do about when the embassies will openBut should i still plan to get my interview by then end of this year or should I plan for next year? This all very much sucks and is extremely sad, just wondering everyone else opinions.

My husband is currently a student so he is not making any income at this time.

In order for him to be my sole sponsor, we would have to have cash/assets worth at least 3 times the poverty guidelines amount for our household size. Is this correct?

For example, for our household of 2, we would have to have assets worth 3 x $21,550 = $64,650

Can I combine my husbands assets with my assets (from Canada, converted to USD) in order to meet that amount?

Praise be to God!

Yesterday I spoke to level-1 officer over phone and requested to connect with a level-2 supervisor. I explained her my situation in detail. She was very nice and booked a call back with level-2 supervisor. I received a call back from level-2 supervisor in next hour. She was very courteous. I explained to her my situation in detail. I told her that I have filed all petitions at the same time. My children s cases has been approved but I cannot move forward due to my spouse s case pending.

She said that she can t do anything because every case is different and my spouse case is under normal processing time of VSC. She told me that I have already been refused on my previous expedite request. Moreover, VSC just responded on my ONPT request that my spouse s case is under normal processing time. She said that she can submit another expedite request if I want but there is no guarantee. I said please go ahead and submit. She submitted my expedite request and gave me a reference no. I received an email after 30 minutes from VSC that my expedite request has been approved. Your case has been approved today. An approval notice is being mailed to you. This petition is being sent to NVC. Please direct future inquiries to NVC. The following are my I-130 journey timeline of all three cases.

US citizen filled I-130 for spouse and two children

Nov-7 NOA-1 from TSC

Feb-23 2 case transferred to VSC and 1 case to CSC

Apr-4 First expedite request refused

Apr-24 K-3 received at VSC

May-4 First child s approved after 180 days

May-13 RFE on second child s case

Jun-20 RFE response received by USCIS

Jun-24 Second child s case approved after 230 days

Jun-29 ONPT submitted

Jun-30 ONPT acknowledged

Jul-1 Received answer from VSC Your case is within our current processing time

July-7 Spoke to USCIS level-1 officer & level-2 supervisor

July-7 Expedite request submitted at USCIS on the basis of family unity and financial hardship

July-7 Expedite request acknowledgement email from VSC

July-7 Expedite request and case approval email from VSC

There were only two date updates on my spouse case. Feb-23 and May-13

6 Month Rule for Being in the US (Canadian)

How long can a Canadian stay in the US? I know there's the 6 month rule, but is this accumulative or all at once? I've been told by various border agents different things. An attorney told me it was 6 months from the last arrival even if she's been visiting on and off a lot the past 2 years (coming every other weekend for a few days).

We are going through a K1 visa process, so we don't want her to overstay and run into issues.

She was never issued a I-94 or a passport stamp at the land border, and never did in the past either.

Attorney advice on voiding K1 and getting married instead

Me (US) and my fianc (Canada) have been going through the k1 visa process. We were 1 week from the interview in March when it got canceled due to covid. She has been here since the border closure in March (got laid off temporarily). We've been waiting patiently to see what will happen with the border closure and the consulate closure. Tbh it's not looking good the more time passes.

Because of this, we decided to contact an immigration attorney to get his advice. He seems to think the consulates will be closed for normal processing for much longer than we expected (8-12 months) and also the border.

His advice to us was this: Since she is already in the US, and we don't want to be separated, we should just get married here, and file a I-130 petition for an immediate relative. He said that since she arrived in the states with no intent to get married, and that circumstances have drastically changed, that this should cause no alarm for things such as visa fraud.

Do you think this a good idea? Is the attorney just trying to scare us into hiring him to help with the whole case? We would hate to void our k1 case, and then also run into issues with the new petition!

Another issue is that she can only stay here for so long in the states (6 months). Can anybody provide clarification on this? When does the 6 month period start? She was never issued a I-94 (arrived via land port), and did not receive a stamp, nor has she ever when she visits. She has came here on and off every other weekend for the past 2 years up until March when she's been here since.

We worry that if she has to go back soon, that we will be separated for a long time due to border closures. This is one reason we are considering switching, so that she can at least remain here with me.
