Canadian spouse who came to US before Covid travel bans ( no i-130 filed yet). Can we apply for AOS? |

I am an American citizen and my husband is Canadian. We were married in a small ceremony in Canada last February (2019) but have not yet filed I-130 for a lot of reasons. We both live close to the border and have been together in a long distance relationship for going on 11 years now, so it worked out fine for us to visit back and forth regularly until we had the money saved up to file. Shortly before border travel bans between US and CAN were enacted, my husband came to stay with me with the intention of staying for a couple weeks. He took that amount of time off work (he works in a restaurant), and when we crossed together, he was admitted entry with no issue. We travelled together because his car was in disrepair, and it's not uncommon for us to drive back and forth together when visiting one another. However, once he was here, things in MI took a sudden sharp turn south in regards to Covid. Rules about crossing have been confusing and somewhat difficult to follow since, and we were unsure of what would happen should we try to cross back into Canada together. His work was understanding of the situation, especially as they had to reduce staff hours due to Covid restrictions themselves, and so he decided to stay here for as long as possible. Now that we are coming up to his 182 days and having to plan to bring him back to Canada, I am heartbroken at the idea of having to be here alone and unable to see my husband with uncertainty of when borders will be open. Both of our mental health has taken a huge hit, as we both already struggle with anxiety/depression outside of the Covid crisis and everything else going on at this time. Our original plan was to file for I-130 once he was in Canada and we were planning to file that as soon as I come back from taking him home...However, I would like to know if there is any way at all possible that we could instead file for an AOS and allow him to stay here instead? I own my home and make enough money that I could support both of us until he gets his Green Card, and his family/friends in Canada would be able to at least visit him here during that time if he could not travel. We are just struggling mentally and want nothing more than to be together at this time.

Hi all, I am completing form I-693 for AOS (not on a K1 visa) and have some questions regarding the most efficient way to complete the form. My questions are as follows: 1. Should I get the STD tests for syphilis and gonorrhea completed by my primary care physician first and then bring those results to the Civil Surgeon? 2. I have a booklet of my vaccines, if I am missing one is it most recommended to get the vaccination from CVS once the Civil Surgeon has identified missing vaccinations? 3. Do I need to go back to the Civil Surgeon after I get my missing vaccinations or do I simply show them to the USCIS officer? 4. How long does it normally take to complete form I-693? Any other experiences/tips would be greatly appreciated. Thank you.

So I called a month or 2 ago and asked what the status of my case was and they said it was waiting to go to the embassy and they couldn't mail anything until the embassy opened up. I just called today to see if it was sent to the embassy because of the recent announcement that k1 is starting to process again. They told me my case went in administrative processing on June 16. It arrived at the NVC June 15th. He said he couldn't give me a time frame for when it would be out of administrative processing and said it wasn't guaranteed to go to the embassy. Is this just a normal phase in the process?

Hi, for those still waiting for USCIS approval like myself I submitted the I-129F in April when should I approx expect an interview assuming with the backlogs at both USCIS and the consulate? My consulate is Montreal and they have just began rescheduling cancelled k1 interviews. I was thinking optimistically around Jan or Feb with most likely our interview being scheduled in March or April of next year. Am I being too optimistic?

I have a few questions. I'm currently dropping K1, and got married in the US and adjusting status - I've been in US since May and intended on going back to Canada in August for my job etc, but decided embassy was taking too long to do interviews, so I'm cancelling the K1, and doing it this way so I DID NOT enter knowing I was going to do this. In the I-485 part 3, question one, it asks if I have ever applied for an immigrant visa to obtain perm. status -- Is it a yes or no for me? I only had gotten to the NoA2 accepted, so not sure if that counts? Secondly, do I include my NoA2 approved paper somewhere in the paperwork? With a letter explaining as to why I am dropping the K1? And for Alien number, since Im filing the I-130 at the same time, I obviously don't have one yet right? Or do I use the one on the NoA2 for the K1?
