In 2015 I petitioned for my ex-husband on an I-130 (spousal k3 visa); he went on to receive his conditional and then his permanent resident card. Soon after he received his permanent resident card our marriage had a serious dissolution and I wasn't happy so I filed for divorce.

Come, 2020 and I am wanting to file a K1 for my wonderful fiance... Do I need to ask for a waiver?

K-1 Visa I-134 question?

So a short background is about five years ago I filed for my ex-husband with the I-485 visa. (long story short, we eloped). I petitioned for a divorce almost four years into the marriage for normal reasons and moved on with my life and found my fiance. I am filing a K1 visa for him now and am filling out the I-134 paperwork and I got down to the "previously submitted affidavit(s) of support" section and filled out my ex's information.

The next section is very confusing for me and I have been scouring the internet and asking questions on AVVO with no concise answer.

The sections 26 - 37 ("I have submitted a visa petition to USCIS on behalf of the following person") I have a few questions

1. Does that only include my fiance who I am submitting a K1 visa for now?

2. Does it include my former spouse? I don't want to put his name if it is going to look like I am making a new affidavit for him all over again but I don't want to look like I am concealing information simply because I'm confused by this particular part of paperwork. Should I just his information about him going through a I-485 in section 7 (additional information)?

3. If I am to include my ex-husband; he didn't get his greencard through the traditional k1 VISA process, but had his adjustment of status immediately by way of the I-485.

Note: I make more than 125% for a household of "3" since I am still technically sponsoring my ex husband so finances are not an issue .

I'm so close yet so far away from finishing all this paperwork, but I don't want to mess up on any of this!

Beneficiary unemployed

Hi all

Will it be a a problem for us if the beneficiary is currently unemployed in his country and petitioner is in school? The parents of the petitioner will be the sponsors for beneficiary plus we have some savings that can get us through until we get the EAD card.

Hi,

I am in a little bit of a messy situation. I am a graduate student in Ireland. This summer I have visited UC Davis for three months with a J1 visa. I received partial funding from Ireland, however I am not an Irish citizen. Now I got a postdoc employment offer and I need an H1B visa.
I was advised by employer (Penn State) to request an Advisory Opinion from the US State Department, to determine if the consular officer made his 212(e) judgement in error. Since my funding came from the Republic of Ireland should not have been entered into SEVIS as Home Government Funding, and therefore should not have subjected to 212(e).
Is this the right way to go? If I apply for a waiver I need to get No Objection Statement from my home country (Bosnia and Herzegovina). I have not resided in Bosnia in the last 7 years and they have nothing to do with my funding.

I have filled in the application tor the Advisory opinion. I was wondering if it is advisable to amend the accompanying self-generated letter to explain my situation, and attach a few documents?

I was not able to input the I-9 number because it contains a letter and the system would not allow me. What should I do?
