US Immigration from Austria

Hi VJ'ers,

One of my colleagues transferred to the US with L1-B on intra-company transfer and has been working in the US for 4+ years. He adjusted his status from L1-B to L1-A in 2018. As you know, L1-A to GC does not require PERM Labor Certification but L1-B does.

He was advised by a lawyer that even though he currently holds L1-A visa, he is still required to obtain PERM, which is going to take a long time for approval.

Can he adjust status without going through PERM? Is there any information from USCIS that explains the process for L1-A holders who arrived in the US as a L1-B?

Hi guys,

I am currently adjusting status from F-1, married to LPR. We initially filed with a joint sponsor because my husband did not meet the income requirements of I-130 at that time. Now our sponsor has been layed off due to COVID-19. He now gets unemployment money and will get his old job back when the lockdown is over. My question is: do they request an actual proof of income from the sponsor at the interview or is everything we sent with the initial application enough? Thanks in advance!

I could really need your help/experiences on this one. I am currently adjusting status from F-1 being married to LPR. As my husband is not eligible for insurance through his employer, we tried getting insurance over the Health Insurance Marketplace of NYS. After going through the rather complicated process they found my husband eligible and me not eligible for enrolling over the marketplace due to not being lawfully present . How they got to this ruling, I honestly don t know. Even more so, as they accepted my documentation in the first place. I provided them with the NOAs for the I-130 and the I-485. Although my F-1 is void by now, I applied in time for AOS and never overstayed. However, the only possibility for me to get insurance over the marketplace now, is appealing this decision. The whole appealing process kind of freaks me out, as I really don t want to have any troubles and I don t know what I sign up for with this. On the other hand, I don t see any other chance to get health insurance. If anyone could share experiences or thoughts on this it would be much appreciated.

Hello to all. My fiancee has a K1 visa. She was finalizing her stay in Austria when the European Schengen travel ban was put in place. Now there is a visa ban that apparently does not effect the K1 holders currently. I would like to know if anyone has ever tried staying in a country outside of the banned area for 14 days and then entered the USA under these circumstances?
