To resubmit or not, i-751 after divorce

Hey everyone,

I hope you are all well!

I filled I-751 with my wife in May last year 2019. Since then the relationship has broken down and we are getting a divorce. Which is about to be filed.

I have been reading around the forums here and have spoken to two lawyers about next steps. But I am a bit confused, I m hoping someone can shed some light and offer some opinions.

Do I need to submit a whole new I-751 package? Or write a basic letter outlining the facts, submit the divorce decree and ask that my case be amended to a divorce waiver?

After reading some topics on this forum, I was thinking I could just write a letter letting them know of the divorce and provide the final decree with perhaps a statement from myself describing the marriage breakdown.

When I spoke to the lawyers they both recommend preparing an entire new I-751 evidence package, one said I should get a statement from my spouse and one suggested not to get a statement from my spouse.

I am concerned that I won t have enough evidence for a new package as I have lost some old bills ect. Our original package was pretty good I believe, with statements from my wife's family members that wouldn t be willing to do that again now that we have separated.

If I do/ do not submit a new i-751 will the case manager/ reviewing officer still consider the evidence from the old I-751?

So my fiance is starting a new job in July and his letter of employment states that the job is for one year (he is a teacher and it states it is for the 2020/2021 school year). His annual income will be well above the income requirements for our household size. Because it states it is for only one year, is that an issue? Should we get a joint sponsor? I am still waiting on NOA2 and my interview will be in Sydney, Australia. But if a joint sponsor is needed I want to have those conversations ahead of time. Also, his annual income stated on this new employment letter will be slightly lower than what was on his tax return/ transcript from last year when he was in a higher paid job. Is this a problem? Do we need paystubs at the interview (we may not have many depending on timing)? Thanks in advance!

I would like to ask if it is okay to put 'MARRIAGE' as purpose for the request of CENOMAR.

Also, how long is the validity of CENOMAR?

I requested last year and included it our K1 fiance visa application. I used 'MARRIAGE' as the purpose, should I use the same?

I-864 - Only filed TWO out of THREE recent tax returns

Situation

My wife is a US citizen and we are at the stage of uploading our I-864, Affidavit of Support.

  • We are using a joint sponsor, but obviously my wife still has to upload an I-864 of her own, even though her income does not qualify.
  • She has filed her tax returns for the two most recent years, 2019 and 2018

In 2017 though - she was a full-time student, made no income and therefore was not required to file a return.

  • We will upload a signed statement explaining this, along with a copy of her most recent tax return (2019).

Question

On the I-864 for Q23a:

Have you filed a Federal income tax return for each of the three most recent years?

---> Does she check NO just because we're missing the third one?

And then Q24c:

3rd Most Recent

----> Does she write N/A and None under income?

Finally, does she check Q25:

I was not required to file a Federal income tax return as my income was below the IRS required level

----> Or is that only if you weren't required to file for the MOST RECENT tax year and therefore have no tax transcript/return to upload.
