Hello all, My fianc recently received her approved K1 visa last week (YAY!) and we've been intending to fly her over here ASAP as it has been 15 months since we've seen each other. We submitted the request for exemption to border patrol and were denied on the "traveling for 3 months or more" grounds (although they did say that we were reviewed for all options). We provided a copy of the visa, the letter from the embassy which states that she will be staying in the United States for an extended amount of time, and a signed statutory declaration which explained our request for travel. They told us we could re-apply with more information if circumstances change... I did not want to book a non-refundable flight without confirmation that she could leave but one of the documents that can be included for evidence is a flight itinerary. I'm debating booking a one way flight, including a copy of that itinerary which will also show that she has 3 checked bags to carry all of her belongings (we aren't shipping anything). Additionally, I just signed up for a 2 bedroom apartment for us so I will get that lease and have her signed on as a renter for a 1 year lease. Is there anything else that you would include or attach that would provide compelling evidence to border patrol? She has no job to show she's leaving because she's quit that ages ago while waiting for the visa... She has no lease or house in Australia because she has lived with family while waiting for the visa to be completed. She is truly fully dependent on me financially until she is allowed to come over here and eventually be granted work permission. Any thoughts are greatly appreciated! I'm still a little shocked that we were denied...

Hello! We just received our NOA2 earlier this week so I was being proactive in looking at our next step. I was looking about on the state.gov for some information for the Affidavit of Support (I-134) and I saw this: Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864? No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline. I meet the current 100% but not the 125% and I have a sizable amount in savings (almost 15,000). I am about $2,000 off on my current 2020 taxes for 125%. My mother has already stated she would be willing to joint sponsor with me, but I was just wondering if I could do by myself or should I just be safe and have a joint sponsor? TYIA

On April 27th I received an email from the NVC to say that our case has been sent to the Sydney Embassy in Australia. I have been checking the Visa Application status on the CEAC website and each time I am given the message 'No Status' and that the case was created on 2nd of May 2021. What does it actually mean? Thankyou.

I'm very confused (although I really shouldn't be) in regards to using chat screenshots and photos as proof of relationship, for my upcoming interview. Do I only need to provide proof of an ONGOING relationship (such as from the time our petition was filed - or approved by USCIS), or does it need to be from the beginning and up to the present time? Also, just how many screenshots should I really use? I have taken so many, that I just can't decide which would be best Do they need captions to describe what the conversations are about? Photos - I really don't have very many of my partner and I together, and the only more recent ones have been taken during our videochats. So I guess that I can only use what I have. Do they need captions too? I have been spending so much time in trying to collate both chat screenshots and photos into a presentable format, and failing terribly, while becoming very downhearted as a result. I've tried using Microsoft Word, but my skills in that program are very minimal, same for creating a PDF file. So now I'm trying Canva, results are yet to be determined. So, what is the better way to do this? I apologise for the many questions, it really is easier I know, than what my mind is making it out to be. There's just a lot that I'm having to deal with right now, that I'm not really able to understand some things as clearly as I ought to.
