Hi everyone, I am a dual US/Australian citizen who is petitioning for my Aussie husband. We are currently waiting for NOA2 but now that the Sydney Consulate is back open I'd like to get prepared for the interview. I am wondering if anyone went through the Sydney Consulate and has experience with proving that domicile was maintained while abroad and/or the intent to re-establish domicile.

I have lived in Australia for 5 years, starting as PR and then I got citizenship last year. While away, I have maintained a storage unit in the US, a checking account, an investment account, an IRA, and I have records of voting, but I have not maintained my driver's license. I use my father's house as my permanent mailing address. I have got quotes for moving our belongings from Australia to US and a quote for relocating our cat from Australia to US. Prior to the interview, I will have correspondence between me and the landlord where we give our notice to move out and emails from work showing that I am leaving my job here (and transferring to US with the company). Based on these, do you think I have enough evidence to prove that I have maintained domicile or the intent to re-establish domicile? And if so, which one? Is there anything else that I could add that I'm not thinking of? Or do you think I don't have sufficient evidence for either and will need to move ahead of my partner and start working and get an apartment and prove domicile that way?

My work will allow me to transfer from Australia to the US, but I know that job offers cannot count towards the income requirement so I will be using assets to prove the financial part.

DS-260 Addresses Gap while travelling/moving

Hi all

I am currently in the process of completing my DS-260 and having a few issues with the addresses section. I have been fortunate to live and work in a few different countries and have taken large backpacking trips up to 4 months at a time when in the process of leaving one country and moving to the new one. i.e. leaving Australia and travelling for 4 months in Europe before settling in the UK and finding a permanent address. I have 5 of these gaps since the age of 16. When filling out the I-130a, I was able to add a note explaining any gaps, but obviously the DS-260 requires something to be entered. I know that these forms should mirror each other.

My question is, do I:

a) Fill out the gap in the street address as "TRAVELLING ABROAD - MOVING FROM AUSTRALIA TO UK - NO FIXED ADDRESS" and put the country as my home country and the dates.
b) Fill in my Australian address for the gap which is where all mail would be sent when I was travelling/moving overseas prior to settling somewhere else.

Hopefully this isn't too confusing to answer!

AoS Interview - Missing K1 packet forms

So my wife and I have just got back from our AoS initial interview in SLC today. Everything seemed to be going well, IO was nice and had some friendly discussion. Asked my wife a few questions about me and had a quick look at my passport, vaccination documents but didn't ask for much else.

We were then informed that he couldn't see the I-129F petition in our files as well as the Medical exam documentation I took prior to my K1 visa interview. They said I was likely to receive a RFE for another medical or possibly secondary interview if he couldn't chase up the documents.

Has anyone else gone through a similar experience? We were baffled that the files we submitted seemed to be missing from their system

Hi all,

I was hoping to get some feedback or advice on my status and plans!

A quick explainer:

Wife is USC, I am Australian and we are both UK Residents.
I-130 submitted on May-21. No Response yet.
Consular interview location selected at London.
Wife starts new job in US around August 22 (I will accompany to help set up).


Now after my wife moves to the US, we will not have a real reason to stay in the UK as I'll quit my job and our lease is up anyway! The only thing tying us back to the UK is the pre-selected location for the interview.

Is it feasible to change the location to another embassy/consulate? For example after I help set up in the US and with the expiration of 90 day ESTA I would prefer to fly back to Australia to be with family and try and find a quick source of temporary income.
My fear is that changing anything with the application process will result in staggering delays and pain.

My ideal scenario would be, I-130 approved within 13/14 months (May or June 22) and a consular interview in 3 months after the fact which means a quick 1 week trip back to the UK for an interview and a pint then back to Freedomland with my GC.

The threats to my plan are extra delays in i-130 processing and issues with buying a 1 way ticket to the US (as I won't know what date to fly back to the UK for the interview).

It should be noted we have an immigration lawyer, though truth be told, they do not inspire confidence.

SSN for EAD during filling

Just wondering, the SSN card i received with my EAD while awaiting for my 485 to be approved states that it is for work purposes only. As my 485 is approved, does this mean a NEW SSN will be sent out? Or is that my SSN now until life and a new card will come with my GC?

(Not sure if asking in the correct area) The guy who did our interview could not answer the question, so im wondering if someone else in this situation could explain how it all works from this point onwards
