I-131 Advance Parole and Biometrics |

Hi ! Does anyone know about how needing to reschedule a biometrics appointment might delay I-131 (Advance Parole) being approved? My situation is that I'm on an H-1B visa (my visa stamp has expired but I have an I-797 that extends my visa, and have an unexpired I-94 along with it), and I have filed I-130 and I-485 concurrently with my US Citizen spouse. My NOA1 was for June 30, 2022 for all my forms, though due to circumstances beyond my control, I couldn't attend my original biometrics appointment (July 29, 2022) and needed to reschedule. I'm still waiting for news about when my rescheduled biometrics appointment will be. The main issue is: I would like to travel in mid-March to attend my sister's wedding in Australia. I have two options: - When abroad, apply for a new H-1B visa stamp (this will cost me a lot of money due to reciprocity fees, needing to do extra travel to visit a consulate, and needing to take extra time off work which isn't a guarantee)
- Wait for I-131 Advance Parole and travel with that (though I'm uncertain whether I'll receive AP in time before March)
Would it be worthwhile risking the I-131 coming through in time and have travel booked? The alternative (applying for new H-1B visa stamp) is very expensive, though offers more "time" guarantee. Also, are there any third options/alternatives that I might not be aware of that can help my situation? Thanks!

I-864 Part 6 Question |

Hello, I am working on filling out the I-864. I am the USC petitioning for my husband, we are both overseas. I am planning to use assets not income to qualify, and I have (hopefully) sufficient documents to prove "intent to re-establish domicile". My question is, since my income is foreign and can't be used for the I-864, which box do I tick in Part 6, if any? There are boxes next to items 1, 4, 5, and 6. I am thinking I should tick none of the boxes (I am employed, so I shouldn't tick "unemployed" even though my income will not be counted for the I-864) and then write a 0 for item 7. Or should I tick the box for item #1 and also write a 0 for item 7? The options are: 1. Employed as a/an.... 2. Name of Employer 1 3. Name of Employer 2 (if applicable) 4. Self employed as a/an (Occupation) 5. Retired since (mm/dd/yyyy) 6. Unemployed Since (mm/dd/yyyy) 7. My current individual income is: Thank you very much for your help!

Hi everyone, I never thought I'd see myself scouring the pages of visa journey again, but here I am! VJ was my best friend when I was doing my GC application 5 years ago. 6 years later & I'm here again, totally confused and have a question or two. (And yes, I have been stalking these pages for over a month now) I am now a citizen. October 2021, I did the i-130 for my son, as he decided he wanted to come and live with us. He was under 21 at the time of filing, but has since turned 21. I guess I'm confused as to what category he comes under. The NOA1 says IR1, (I thought this was for spouses?), yet when I look at the timelines, the categories confuse me and can't work out which one I should be looking at. Would someone be kind enough to make it a little clearer for me please. March 2nd, I got notice that they were actively reviewing the case. It says Nebraska service center at the bottom of the NOA. Hopefully that made sense. Any help would be appreciated. Thanks

Hi It would be great if I could get some solid information regarding my question. My husband and I are currently living in Australia and applying for my green card from here. My inlaws are going to be my joint sponsor We are earning foreign income so obviously this doesn't count. My inlaws both receive social security and would like to combine this as income and they are both retired. Hence they have not done their taxes and don't have W2. Will a SSA-1090 suffice for each joint sponsor? Thank you

I received an RFE today, to provide the correct NZ police check (I submitted the wrong, but know how to fix it). Having re-submitted the document into the CEAC portal, the "date uploaded" hasn't changed and still remains as the 28th April. Just wondering how this RFE response will impact my timelines? Particularly I don't have a received document upload date.
