Small error on DS-260

I recently submitted my DS-260 and went over it with a fine-tooth comb about 20 times. Everything is correct, but today I remembered that we transited through a country on one of our flights to the US in 2017 (left the airport and stayed overnight at a hotel before getting back on the plane) and I completely forgot to add it to my countries visited in the last 5 years. Is this something worth unlocking the DS-260 for or should I just flag it at the interview? By the interview stage it will likely be outside the 5 year time frame anyway as the brief visit was in September 2017.

I-864 Employment and Assets

Hi all,

We're a little confused as to how to proceed with the I-864.

Status:
Petitioner and Beneficiary both living in the UK.
Petitioner moving back to the US in 2 months to start new job.
Beneficiary will move to US the help establish and then hopefully wait out until my green card interview (I-130 recently approved, case at NVC).

I am aware that current (foreign) income is not permissible for the I-864 but where does that leave USC who do not work in the US? Does this mean that the NVC process cannot begin to start unless the USC returns to the US and the couple is forced to be apart? Petitioner has a job offer from 2021 with a contract start date (selected by Petitioner) in 2 months time.

If the above situation of required separation of couples living outside of the US is true, what other methods can be used to prove financial stability/safety.

We do have savings, however what I have read seems to indicate that you must show savings equal to 5 X 120% of the HSS Poverty Guidelines ($22,877) = being $114k. Which we sadly don't have.

How do can we proceed with the process without further delay or needless separation.

Tax Transcript Question

Hi everyone, I am a dual US/Australian citizen who is sponsoring my Aussie husband. I am reading the instructions for the I-864 and on page 8 it says "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most
recent tax year." My question is what is the most recent tax year? I have my tax transcript from 2020 but my 2021 tax transcript is not ready yet because we had to file an extension when I did my taxes this year (bad thing to do on the year you are immigrating, I know, but we live overseas and this is as soon as my US accountant could do it).

Can I submit my 2020 tax transcript or should I wait until the 2021 tax transcript is available? Should I submit the I-864 now and upload the 2021 tax transcript when it becomes available? I am not using income to meet the 125% guideline, if that matters, we are using assets instead.

Sydney Consulate Re-establishing Domicile

Hi everyone, I am a dual US/Australian citizen who is petitioning for my Aussie husband. We are currently waiting for NOA2 but now that the Sydney Consulate is back open I'd like to get prepared for the interview. I am wondering if anyone went through the Sydney Consulate and has experience with proving that domicile was maintained while abroad and/or the intent to re-establish domicile.

I have lived in Australia for 5 years, starting as PR and then I got citizenship last year. While away, I have maintained a storage unit in the US, a checking account, an investment account, an IRA, and I have records of voting, but I have not maintained my driver's license. I use my father's house as my permanent mailing address. I have got quotes for moving our belongings from Australia to US and a quote for relocating our cat from Australia to US. Prior to the interview, I will have correspondence between me and the landlord where we give our notice to move out and emails from work showing that I am leaving my job here (and transferring to US with the company). Based on these, do you think I have enough evidence to prove that I have maintained domicile or the intent to re-establish domicile? And if so, which one? Is there anything else that I could add that I'm not thinking of? Or do you think I don't have sufficient evidence for either and will need to move ahead of my partner and start working and get an apartment and prove domicile that way?

My work will allow me to transfer from Australia to the US, but I know that job offers cannot count towards the income requirement so I will be using assets to prove the financial part.

DS-260 Addresses Gap while travelling/moving

Hi all

I am currently in the process of completing my DS-260 and having a few issues with the addresses section. I have been fortunate to live and work in a few different countries and have taken large backpacking trips up to 4 months at a time when in the process of leaving one country and moving to the new one. i.e. leaving Australia and travelling for 4 months in Europe before settling in the UK and finding a permanent address. I have 5 of these gaps since the age of 16. When filling out the I-130a, I was able to add a note explaining any gaps, but obviously the DS-260 requires something to be entered. I know that these forms should mirror each other.

My question is, do I:

a) Fill out the gap in the street address as "TRAVELLING ABROAD - MOVING FROM AUSTRALIA TO UK - NO FIXED ADDRESS" and put the country as my home country and the dates.
b) Fill in my Australian address for the gap which is where all mail would be sent when I was travelling/moving overseas prior to settling somewhere else.

Hopefully this isn't too confusing to answer!
