I am currently in the K1 process and have seen so many different answers on here regarding what financial documents to bring to the interviews. And if one is supposed to be 100% over the poverty line for K1 and 125% over for Adjusting Status. I have seen the Packet 3 requirements for Australia so far and for the i-134 it is so broad as to what I should bring? I do not have tax returns because I am a college student, although I started a full time job the beginning of this year and definitely meet the income requirements. I just have no clue what to do for the k1 process so far?

Hi guys!

Been a while since I've dealt with all this and my memory is a bit fuzzy from the last time. I divorced my Australian husband after 10 years and swore I would never date another foreigner again - only to fall in love with an Englishman! So, here we go again!

I have been back through the guides and stuff, but what I can't recall is how long the medical and police records are good for. My fiance is coming over in December and staying for three months (and hopefully getting an interview right after his return home!), so we're concerned he may not be home to do these things ASAP.

If he does them right before he comes over instead, will they still be good for a few months? We want to be able to fire off everything immediately when we can.

Also, I read somewhere that police records aren't required for all countries. I don't remember that being the case when I filed last time (but that was a while ago, time can change things!). Is that the case and how do I find out if it applies to him?

Hi All..

I know I m going to have to talk with a Tax Professional about this.. and also think it s somthing I should do sooner like before leaving Australia rather than later.. but

Can anyone explain in basic English to me the USA tax rules about my Australian superannuation?

Im hearing that USA doesn t fully understand our super system given it s enforced by government but run privately either by finance companies to invest or by SMSF (SMSF is what I m thinking to do, but worried it will again further complicate things). therefore earnings on investments, interest etc end up becoming something like foreign income... even though the government here will tax it ? True?

Im in the process of migration and really want to protect my super from being eaten up by the IRS given it is a retirement fund similar to but still not similar to your social security... I think it s closer to 401k but don t know for sure.

Also, what happens when I retire? I know I don t get my social security but will share my husbands... but how is our retirement affected by my superannuation?

AOS with Dual Citizenship

Hi All!

I'm a currently a little confused with the AOS forms. Long story short I have dual citizenship and I'm at the stage of filing the I-485 (AOS), I-131 (AP) and I-764 (EAD) from a K-1 Visa. The first two forms has only one field for nationality and the EAD form asks for more than 1.

The question is how would one fill out the AOS and AP forms, do I list Country A / Country B as citizenship or just the passport that I used to apply for the K-1 Visa?

I-130/I-485 filed together... my bad?

Hello,

We, (meaning I), may have been a bit too eager with our petition and application. So I'm not sure what happens now, seeking info.

I believe I had read, a number of times (on VJ and other sources), that the I-130 and I-485 packets could be filed together.

So we got them ready and filed them.

We submitted our I-130/I-130a petition packet (to Dallas Lockbox), and our I-485/I-864 packet (to Chicago Lockbox) at around the same time.

We received our NOA1 for the I-130. We haven't heard anything in relation to the I-485 application (which we tracked with USPS as delivered on Oct 14th, postmarked Oct 10th).

Some time passed and with a fresh outlook I started seeking info about when we might get a receipt letter for our I-485.

I then realised.. seeing I (Australian citizen) am not living in the US with my husband at the moment, the whole 'filing the I-130 & I-485 together' thing really isn't applicable to us...or is it?

So where does this leave us? Will our I-485 application likely be rejected? Or just held there ready to be processed once the I-130 is approved?

Beginning to second-guess what I've done now.
