Hello all. This is a really early question to ask given our immigration journey has just started but it's better to be prepared for when the NVC stage arrives. We will need a joint sponsor as my husband (the USC) has lived in Australia for the past 12 months on a tourist visa and has not worked. He moves back in Jan 2020 to re-establish domicile and to obtain full-time employment to ensure there are no issues with public charge etc. I have read the form for the Affidavit of Support and have a question that would concern the joint sponsor. The joint sponsor is in the US military. He is technically a reservist for the navy but he is on active duty orders for a couple of years. When it comes to the filling out the form, would he tick YES or NO to the question regarding active duty? If he does tick active duty, aside from tax transcripts etc, would he need to prove that as a joint sponsor? He is also a friend, not a relative. My husband and our joint sponsor both joined the navy at the same time and did boot camp together. Will the fact that he is a friend and not a relative affect the joint sponsor application or the visa application as a whole? We've both explained what it means to be a sponsor/joint sponsor and he is OK with it (for now anyway). I've read that the CO might question it? It is super early on, I know but if there is any issue then we feel its best to know now rather than wait to find out.! Thank you!

so long story short Dallas field office takes forever.. wait time is 12-22 months I believe or longer. my PD is March 22nd I received EAD combo card in July and I booked a ticket home for Christmas. I leave Dec 19th today I received a text saying interview has been scheduled. now I know that's usually set 4 weeks roughly from when you get the interview letter. problem: I will get letter this week obviously and will see the date im guessing its going to be within days of me leaving or potentially just after I leave. I know you can re schedule but I will be gone for 4 wks and whos to say they wont re schedule for 1-2 weeks after original date (which I will still be overseas) question is: obviously I still have a valid EAD combo card with advance parole. will this still be valid should my interview date be before I leave and go well?? if we get approved and card sent to my address.. on my return I will have combo card but will not have gc in hand.

Hello, Over the weekend we received our I-485 packet back with a rejection notice I-797C. On it the document stated: "Your I-485 fees, and any supporting documentation is being returned to you for the following reason(s): Based on the information provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed at the bottom of this notice. The following documents may be provided: -Your original Form I-130 -your original form I-140 -your Original form I-1360 -A Copy of your Form I-797 if your I-130, I-140, I-360, or I-526 has already been approved. -Or other evidence that an immigration visa petition has been filed/approved" Now from what I understand it looks like they want an I-130, but we got approved for a K-1 visa so a I-130 should not have been needed, and we included a copy of the petition acceptance I-797 as well as a copy of the visa page in her passport. Did I miss something or am I correct that we do not need I-130? Also if I do resubmit it should I return the packet I got back that was filed before October 15th or fill out a new one since the forms have changed?

Hi all, I-134, PAGE 2, PART 1, QUESTION 12: This question asks for the age of the sponsor and the date since they have resided in the USA. If the sponsor is an America citizen would they right "N/A" here? Or would they fill in their age and their DOB (as their DOB is the date that the started residing in the USA). My feeling is you would write N/A as it states to only answer questions 11-12 if the sponsor is NOT a US citizen by birth. The reason I am confused is because the sample I-134 on VJ has this question filled out. Does anyone have any experience with this? Should I just write "N/A" or fill out the sponsors age and DOB. Thank you!

Hi all, First off, huge thank you for the support this community offers. I have recently received an email from the NVC saying my petition will be forwarded to the US Embassy in Sydney, Australia for processing. Is it too soon to complete and pay for my DS-160? Or should I wait for the embassy to contact me? Also- when my fiance (petitioner) is filling out the I-134 does it matter that he dates and signs it before I have an interview scheduled? He will need to mail it to me from USA to Australia so I just want to make sure I have plenty of time to receive the form and supporting evidence before my interview is scheduled. Thank you for your help!
