Reapplying for ESTA?

My Aussie partner visited the U.S. in November under an ESTA. It was granted in November and the passport stamp/I-94 says that it expired on 02/02/2020. She was only in the U.S. for a week and a half.

She would like to visit me in April and I'm seeking clarification on her reapplying for an ESTA. Would there be any issues or things we need to be aware of with her reapplying?

*I'm also sending off our I-129F tomorrow and we're looking at ways to show that she's just visiting, like a return ticket, house lease, work agreement etc...

ROC Evidence - Need Advise

Hello all.

My ROC window opens on April 7, 2020. I am starting to gather evidence and drafting a cover letter. Here's a list of the evidence we are thinking of submitting for ROC.

  1. Copy of Marriage Certificate, just in case USCIS lost our copy.
  2. Copies of current, expired and voided DLs & IDs showing same address (current & previous residence)
  3. 2017, 2018 & 2019 (pending filing) Tax Return Transcripts from the IRS (married filing jointly)
  4. Bank statements from our joint checking account
  5. Monthly joint gas bill (only 1 under both of our names)
  6. Car Titles under both of our names
  7. Hubby's health insurance statements showing me as his beneficiary
  8. Current and previous automobile, home & life insurance policies showing both of us as principal insured
  9. My Employer's Emergency Contact form showing hubby as my emergency contact
  10. My 401k statement showing hubby as the designated beneficiary
  11. Travel Details to the Philippines and boarding passes (only one travel history where hubby & i went together)
  12. Various photos together with family and friends

Question for item #5, hubby and I only have 1 joint utility bill . All other bills are under his name. Cause I am not included on the mortgage, as some utility companies require that the individual must be on the mortgage to be a joint account holder. I pay some bills using my personal Credit Card, and the rest using our joint checking account. We do not have a joint credit card account. Is it sufficient evidence to just submit copies of the one and only joint utility bill? Or can we submit all other bills under his name and our current address and include payment/transaction history showing I/we are responsible for paying them?

Sydney Consulate- Non-Australian Citizen

Hi Everyone!

My fiance (beneficiary) has been living in Australia for a majority of his life on a student visa. I have recently filed the I-129F application. While researching the typical consulate requirements and document needs, I came across the following on the US Consulate-Sydney website:

"Immigrant visas to the United States are processed for citizens and residents of Australia only at the U.S. Consulate in Sydney."

Does this mean he will have to go back to his citizenship country for his interview? He has never lived there and has been in Australia since he turned 18.

Does anyone have any experience with this situation and the US Consulate in Australia?

He currently lives in Melbourne. We would like for him to have interview there and that's what we listed in the I-129F. But looking though the consulate website, I am a little unsure.

Any help/guidance would be really appreciated. I am slowly descending into panic mode!

I don t know where to submit this so move if in wrong forum or delete if not allowed but am frustrated!

This whole visa waiting game is hard but it has to happen ...

But what makes us (husband and I) frustrated is people who want to enter the US on a tourist visa and just stay because it s quick and easy.
it s the people who don t do it the proper way - the way we are doing it.... via consular processing etc if that s even the proper way - who knows

Ive told the same person on FB 1 million times that wife cannot enter USA on tourist visa with intent to immigrate ... but they just want a quick, easy way for a green card - like don t we all? Don t we all want to be with our spouse?

if all due respect to others I really find it hard to also believe that someone went on JUST a holiday and then circumstances changed and they just stayed no furniture to sell? No rental to cease? No car to sell? I don t know, resign? Do the right thing and give your 2 weeks notice? Get all your belongings? End your life in your home country before you make a new life?

this is really frustrating to see. It s a really lonely process that is just full of the unknown .

it is the path we picked - consular processing because (a) don t wanna commit visa fraud especially if I want to be an attorney and (b) because it s the right way? Correct me if I m wrong.

single parenthood while we wait is hard. Lonely and hard and yes a consequence of our actions still lonely nonetheless.

N400 assistance

So the USCIS military helpline appears to be less than helpful, I'm hoping someone from here can assist me with my question. I'm completing the N400/application for Naturalization, since we were stationed in Germany for 3 years and according to INA319 8.USC 1430 part e (excerpt below), this counts toward physical presence if you accompanied your military spouse on orders.

We returned from Germany July 2019, so we've been back stateside for around 7 months now and I've been a LPR since late 2013.

"(e)(1) In the case of a person lawfully admitted for permanent residence in the United States who is the spouse of a member of the Armed Forces of the United States, is authorized to accompany such member and reside abroad with the member pursuant to the member's official orders, and is so accompanying and residing with the member in marital union, such residence and physical presence abroad shall be treated, for purposes of subsection (a) and section 1427(a) of this title, as residence and physical presence in-

(A) the United States; and

(B) any State or district of the Department of Homeland Security in the United States."

How and where do I add our orders? in additional evidence?

anything else unique I need to know?
