  1. Wrong If they were prime Candidate then it would be much harder to get a Tourist Visa from Philippines for a parent. Just like it very difficult to get a Tourist Visa from Philippines if you are young and single. 2 years is just a blink of an eye for an old person, time moves fast the older you get. I was at a Fil Am Thanksgiving on Thursday, I spoke to an older lady and asked her what visa she came to USA on, She was around age 60 plus from Philppines, said her sister had petitioned her, She told me it took like 20 years for her approval that is a long time. I have been seeing her for the last 10 years or so each holiday season. I am not sure how long she has been in USA.

  2. Start the I-130 now. Financial docs and I-864 won’t be needed for a while . After USCIS approves and sends case to NVC ( at least a year) , USC Petitioner files an I-864 and Joint Sponsor also files I-864. No worries , it’s ok for Petitioner to earn little or nothing as long as he has a rich auntie😂

  3. You (the OP) keep minimizing and downplaying these offences. The dates don't matter, so get those thoughts out of your head. If asked, explain them directly and concisely without editorial comment. I don't really understand what those offences are. The terminology is not familiar to me. Sounds like you were never arrested or convicted. Please be clear about that. Did you ever go to court and be sentenced? Did you lose your driver license for six months? Personally, I don't consider speeding tickets or failure to have a current inspection to be criminal matters. You are disclosing these because they are on the report. Unless one or more is an actual criminal offence, I would neither worry about them or tick yes to that question. If you do, then see if a question comes up about them. If it does, answer "five traffic related offences, related to insurance and inspection stickers". If you try to minimize and downplay instead of giving direct answers, they are likely to start wondering what else you are misrepresenting.

  4. Thanks for the update. Definitely attend, and you may find when you get there that it was scheduled in error.

  6. USCIS has seen this construction before, so they might look at your case a little more closely, yes.

    I-864 For AOS

As a K1? Are you using your new married name moving forward in life? If yes, your legal name IS your married name. Inputting your new name is HOW you "change" your name on paper as an immigrant. If no, and you choose to remain known as your maiden name and have not elected to take a new name, your legal name is your maiden name. Of course, you always list previous names as asked as well. Please fill out your blank VJ timeline in reciprocity. Your timeline stats help ALL VJ members while our answers help YOU personally. A blank timeline helps no one (and in your case, can even cause confusion because your post doesn't state you are a K1 and could easily have been placed in the wrong forum. A correctly filled out timeline will prevent an undetailed post from being misconstrued.)

  9. If you cannot edit the DS 260 then stop worrying about it. If asked at the interview, just be factual. Clearly, you are not hiding anything. These are not disqualifying issues, but your obfuscating attitude about them could be a problem. Smile, and say, yes, I had some vehicle related violations back then. They can read the dates and do the math.

  14. Update - November 30th notice of biometrics re-use and case status online reads “case is being actively reviewed by USCIS.” we have access to all documents online so we can see all notices. We can also see uploads of the package we sent. we hope this process is fast and smooth as the original green card which took less than 90-days from submission to receiving the card. Crossing fingers.

  16. Agree with the above, filing a WOM this early is likely to get the case dismissed. I’d wait until a year at least.

  17. 6 months is not that long for extended AP. Filing a WOM is a bit risky.

  20. Thanks for commenting! The USCIS processing times for N-400 at Seattle now say 6 months for 80% of applications. Having waited 18 months for I-751 and 13 months or so for AOS from K-1, we’d be thrilled with that! When I first joined VJ in 2016, Seattle processing times were up to 2-3 years, so there’s been progress!

  21. Well, we finally got the letter - and it just adds question marks. It is an exact copy of our earlier interview appointment letter - both even say "First Interview" - just with a different date on it. December 6. Same instructions, same note that "if your application is marriage based, your spouse must attend," same word for word except the dates. Well, okay... guess we'll see what happens on Friday.

  22. Husband filed his N-400 online on 11/29/24 under the 5 year rule. Our LFO is Seattle, which has historically been a backlogged office for citizenship interviews. Hopefully things have sped up! Good luck, everyone.

  23. Expect scrutiny on this. It's not an uncommon thing to see someone gain immigration benefit through a US citizen, divorce and then want to bring in another person from their country of origin. Very old trick. Is yours and your new partner's country of origin Canada? That might make it less suspicious, IMO, if you are both Canadian by birth (low fraud country, generally).

  24. Through her USCIS account we received Notice of Receipt of the N-400 application and part of that notice says that the notice itself automatically extends the I-551 24 months past its expiration date, so hopefully that also works for the temporary I-551 in the passport. Following your link to the state dept, they have a lot of helpful information that I haven’t seen before, including a statement that the N-400 can be submitted using the passport temporary I-551, and they recommend using the Washington DC office as they are used to processing expeditious N-400s and are next to a passport facility. I had selected the San Antonio USCIS facility because I think it is likely that we are stationed at Fort Cavazos, Texas next. Not sure if the selection can be changed now, but we will see. I will call the Riyadh Embassy RSO tomorrow for fingerprints, or we can possibly drive to Doha’s USCIS office and do the biometrics digitally and maybe be able to give them the documents for the visa packet at the same time.

  26. Trump was only a Nazi as long as it was seen as assisting the Democrats campaign to win the presidency back in November. As soon as it was obvious he had won, the Democrat political wing ceased calling him that. All we hear now are the echoes in the media and the diehard liberals out in the wild. Because he is not and never was remotely close to being a Nazi.

  27. They ARE criminal offenses! As above - a traffic offence would be a speeding ticket, or driving with a busted taillight. Driving without insurance is criminal, not civil.

    I-864 RFE Questions

This is a full standard form letter that is always used .. and then specific issues for your individual filing are marked out added on at the end It’s obviously easier for them to send the full text plus rather than tailoring each individual letter. But yes it can be confusing

  30. For "Metro Manila" put "NCR" as the province. (National Capital Region). Put the actual city, IE Pasig City. There is a 4 digit zip code. You may have to Google that. All addresses should include a barangay. Beyond that, freestyle rules apply and it is a very inexact science. There might or might not be a subdivision, purok, street, block, corner, sito, prominent building or landmark house number, etc. If it is just for informative purposes on a visa application then the format is probably not that critical. If you actually expect a real delivery of something at that address ask what if anything was ever successfully delivered there before and what address worked. IE, have they ever ordered stuff from Lazada before? The most critical part of any address used for actual delivery is that they have a good, complete, reachable cell phone number that would really be answered. Since probably half of Philippine deliveries come down to the delivery guy getting to the general area and calling or texting to ask for directions. Delivery guy in the Philippines has to be one of the most challenging occupations on the planet.

  31. You don't need to change child's birth certificate if you're listed on it. You can prove your citizenship during CRBA by showing your paperwork proving you're US citizen.

  32. Unlikely. You're most likely citizen of both countries. You can hire a reputable lawyer in Pakistan who would know for sure whether you're a dual national or not. To give up / lose citizenship you typically need to work with government of citizenship, pay fees etc. If you never submitted any paperwork to Pakistani authorities to renounce your citizenship, you likely still have it.

  34. I disagree in this particular case. I have seen plenty of parents denied B2 visas. Elderly parents of US citizens are prime candidates to skip the long immigrant process and overstay tourist visas, then stay. That is just reality. The OP's parents are not in the Philippines, so your experience doesn't apply in this particular case.

  39. I am worried too for that same reason but we have no control over these things so I take comfort in knowing Trump is after illegal immigration. We are all doing it the right way so we will all get through with no additional days. Times like these we have to put our trust in higher powers.

  41. Today is the day! Smooth process for N400 interview. Arrived and seated in the waiting area 10 mins before appt time. I waited for 15-20 minutes and got called by the IO. Started with an oath and handed over the appointment letter, passport, GC, and DL. Followed by civics tests. After that, he asked me a few questions on the N400 form, like your work, address(Yes, you do need to remember the company address even tho you work remotely or freelance), and duration of the work, if I have been abroad for over 6 months(he didn't ask how many times and how many days), and Yes and No questions. After all that, he handed me the same day's oath ceremony paper. I headed downstairs for the oath ceremony, waited 30 minutes, and had the ceremony with around 15 other new citizens. That's it! They gave us the naturalization certificate on the spot and briefed us on how to apply for a passport. I guess that's it for the USCIS journey. It's been a rollercoaster, but once you're on the other side, everything seems just fine.

They received his RFE October 17, and we got the approval today. Last update is the we have placed you in line for oath ceremony status.

    MANDAMUS LAWSUIT

My Wife finally got an email for passport submission and re-medical after being stuck in AP for over 8 months. Her re-medical is on the 26th of April but, can we submit and mail her passport to the embassy before then? Please let me know thanks. And yes we hired a mandamus lawsuit lawyer, and it worked.
