    I can only tell you what I see in the law 🤷🏻‍♀️. I’m not going to argue. Lawyers also only have the law. I agree it is up to the panel physicians but it doesn’t seem to make sense that they wouldn’t follow the law. Good luck to you on your visa journey!

    Just thought I would post this for people who are confused as to whether this applies to those having medicals done at consulates/embassies abroad: These are the official guidelines for panel and civil surgeons to follow in the US and abroad. https://www.ecfr.gov/current/title-42/chapter-I/subchapter-C/part-34/section-34.1 This link is referenced from this page on the official USCIS website: https://www.uscis.gov/tools/designated-civil-surgeons/vaccination-requirements and states "CDC is responsible for publishing the Technical Instructions for Civil Surgeons. These documents and the HHS regulations set the requirements for the immigration medical examination and are binding on civil surgeons (See the CDC Vaccination Technical Instructions for Civil Surgeons and 42 C.F.R. Section 34.3)." If you read 34.1 through 34.4 you can clearly see that it does not reference anything about the Covid 19 vaccination any longer and the first page (34.1) states that these medical exam guidelines apply to BOTH a) Aliens applying for a visa at an embassy or consulate of the United States AND d) Aliens applying for adjustment of status. Specifically, you can reference 34.2 part d2 and part l2, 34.3 part a2, and 34.4 part bii. This was the date updated:

    The vaccines for k1 are for the adjustment of status. Technically k1 applicants don’t have to take the vaccines until they apply for that. Therefore it should apply to k1 applicants at their medical before they come to the US.

    I see. So, it won't cause issues that on the USCIS website it still shows as "Approved"? Yes, we got divorced in Russia and I got a notarized translation of the divorce certificate as well. Thank you for your response!

    Hello - I know it might be something I should just call USCIS about, but I thought I'd try here first. In July 2020 I sent in an I-129F for my now ex-husband and it was approved in February 2021. He was Russian and there were issues with cases even getting sent to any embassies at that time, so we decided to just get married in Russia and I moved there. I never sent anything to USCIS, NVC or the consulate/embassy withdrawing my approved petition. Well...now four years later I find myself in another relationship with a man from Norway and we were thinking about trying the K1. I saw on the application that you have to put your old case number and when you filed, and I did find this online through my old USCIS account, but the status still says approved. Do I still need to contact USCIS to withdraw the petition? I figured after four years it would have just expired and been removed from the system. 🫣 Thanks!
