  3. This was incredibly helpful - thank you. I have been reviewing the I-864 instructions, and it seems like submitting the tax transcript is the "recommended" option compared to a complete tax return (W2, 1099, 1040), but the I-864 instructions themselves do request all sponsors include "A copy of your individual Federal income tax return, including W-2s for the most recent tax year." My default instinct is to provide everything, but it seems in this case that will result in an RFE. Any suggestions?

  6. The DS-3025 is the vaccination document worksheet! The K1 beneficiary should have received that form from their medical exam before the K1 interview.
  7. Hi! I am a US citizen married to a K-1 visa holder, prepping our documents to apply for the AOS. I was reviewing form 1-485 Part 8 and caught that I incorrectly selected "No" when it asks whether the applicant is subject to the public charge ground of inadmissibility under INA Section 212(a)(4). I've corrected it to "Yes" and am filling in the subsequent sections I now need to complete. Some questions I have: When it asks for household income, does that include both my income or just my husband's? My husband has no income, naturally, without his EAD yet. For household assets, would that also be a combination of both of our savings or just my husbands? And for my husband, would we include his savings that are still abroad and just convert to USD? For household liabilities, my husband has no debt but I do have a small balance of student debt I am still paying off. Would that be included? I'm assuming supporting evidence would be required for the above, if applicable? Bank statements, student loan statements? Thank you in advance, VJ Community!!

  9. I am currently filling out the I-864 and trying to make sure I cover my bases to avoid an RFE. My income is over the minimum poverty guidelines required, which based on the instructions means I can include just my tax returns for the last 3 years and be all set with evidence? Would there be any harm in including additional evidence of my finances and employment: - Employment verification letter - Pay stubs - W2s Thank you!
  10. My husband and I are currently filling out the I-485. Section 24.a asks if you have "ever been a nonimmigrant J visitor who was subject to a two-year foreign residence requirement." My husband previously worked in the U.S. under a J1 visa back in 2016, and does not recall any 2-year requirement. Following his J1 visa, he lived in New Zealand for 6 months, Canada for 2 and then France for 4 years (so I am hoping he would pass that requirement if it was required?) Not sure if we would answer No for this question (not subject to this requirement) or if we should answer Yes knowing that he did live in France for 2+ years between U.S. visas. Any insight is appreciated!
  11. Yes, we weren't expecting it either! He was able to open the bank account using his SSN, and they asked that he bring in a copy of a physical card at a later date. 🤷‍♀️ It seems like he can apply for a replacement card only once he has a work permit. Or, the Social Security website seems like they can only issue a replacement card without a work permit if a "federal law requires for a particular benefit or service."
  12. meaning say no to issuing a SSN card on the i-485? My fiancé needs a physical SSN card to finalize opening a bank account, so I guess applying for a new SSN card directly with the Social Security Office would be the best next step?
  13. Thank you, everyone! There is a section on the i-485 that specifically says "Do you want the SSA to issue you a Social Security Card" which from how it sounds would resolve our problem? Not sure how long it would take to receive that card, or if there would be any issues with it being a reissued SSN card versus a new one.
  14. Hi! My fiancé (beneficiary) has just arrived in the U.S. with his K1 visa, and we are starting to prepare the paperwork for our green card application as we are getting married next week. My fiancé previously worked in the U.S. through a J-1 visa, and therefore already received a SSN. While he no longer has the physical card, he still remembers his SSN which is what we have entered on our paperwork throughout the K1 process. When filling out the i-485, it seems like a new SSN card can be mailed to my fiancé. Would there be any benefit of my fiancé going to the Social Security Office to apply for a new SSN card before submitting the i-485, instead?
