  1. Oh yes, Gemini is usually 2 years late with anything, LOL. I actually asked my husband (a lawyer) to recheck the IRS and he confirmed that in this case we can't do much, Interpretation of immigration laws can be a minefield. It depends also on the office working with that application. We will just await for the GC now.....meanwhile I sent an email to USCIS just in case.:) Thanks for all the help...!
  2. Thanks. So I checked again and my husband said only SSN was accepted. I checked with IRS site and gemini and got this: The Child Tax Credit or Earned Income Tax Credit explicitly require a valid SSN (not an ITIN) for the qualifying child to be claimed. Therefore, while an ITIN would serve for general tax identification if your teen doesn't have an SSN, receiving the SSN through the immigration process is crucial for accessing these particular tax credits.
  3. The system here makes it so complicated to edit, reply etc. so I will try a grouped response. Re. having the tax credit money back, this is a good thought, but you can't do that with the child tax credit if the child didn't have a SSN by the due date of the original return (including extensions). So if she doesn't have a SSN by Oct. 15, I couldn't later amend our return to claim the child tax credit. Second, to OldUser, we tried online and could not, so we called the call center at the regional office and they said we could do it in person. At the arrival to the office, we were denied as she does NOT have permission to work. It appears that people are responding without having read the many times I have specified this. Only after 2 days of writing here, my husband corrected me and reminded me that YES when we did the AOS we absolutely ticked YES for SSN number for both of us, and we also applied for EAD for me. However, while I did receive SSN and permission to work within 3 months, my daughter did not receive any SSN. Thus my questions re. tax credit, because we would save 2k if she had the SSN and was listed as a dependent. She cannot apply for a TIN number because that is for non residents and she IS resident. I did get a TI N number (or EAN? can't remember) some 10 years ago when I was living in the UK and working with Zazzle, and because I was non resident I received one. I hope that this clarifies this total mess!
  4. sure but we didn't know that it would take a whole year for the green card, and that she would need the SSN earlier, and that for tax purposes she did need that SSN. It was not in any notes we seen, not on the IRS site, not here as far as I know. We did ask many times and nobody mentioned the above. So now we are stuck not knowing when then GC will arrive. As on a average hey are now taking 10 months and its been 11 I assume we are closer...

We did not know that an SSN number would be impossible to get and since the wait is very long and costing some $250 (while the Green card might arrive before the permission to work) we stopped thinking about it. Then 2 months ago my husband realized that in his tax form he could add my daughter, but ONLY if she had an SSN. As my green card is due now any time, we thought it was a waste of time and money to send a new application....
  6. We only did adjustment of status as we didn't realize she could not get a bank account or tax credit without it. Very frustrating. And unsure why It takes 3 months to give a permission to work and an SSN!
  7. Thank you. The child IS resident (and not going to be adopted) and therefore when we went to the SSN office we were refused the SSN number a couple of months ago.
  8. Hi all! So we filed in mid August for adjustment of status for me and my teen. The USCIS site says now it takes on average 10 months to finish the process. So I gather we are due to get some communications any time? For a couple of months we wondered if it's better to file for my teen to have the SSN (as it takes 3 months and costs $$$ we didn't quite feel compelled). However, because she doesn't have an SSN we can't add her as a dependent and thus we will lose thousands in tax credits, due I think by October. If you have filed from the UK and are now under whichever office works with Wyoming and similar areas maybe you have some experiences to share? PS Although our medical was pretty much complete when we left, we had the Covid vaccine in September and we didn't have the flu vaccine (we have the MTHFR mutation which makes it difficult to expel toxins). Thanks!
  9. Good to hear. However as we assume it might be autumn before they pick up the papers and make a decision, it will be flu vaccine time again. I think it’s silly to require it at that point as we have been in the country over a year and had all chances to get the flu anyway. And the last time I got the flu was 1999.
  10. hello there, I wonder if you have any suggestions for me. We moved to the USA in June 2024 with a K1 visa and filed for Adjustment of status in the end of August, also asking for me to have a week permission and an SSN. All went well and now my teen who is 17 is always asked for the SSN, so I thought I would file for her too, which is $260 so not an expense I want to make unless I am sure that the Green card will arrive very late. We used the California centre for petition (not our choice, we live in WY) Looking at the stats in this website, the days between Biometrics and Decision Date is currently 256. Today is April 26. It looks like 256 days after September 11, 2024 is Sunday, May 25, 2025. In the last 3months though, the average days are 168. Therefore, if the average processing time has been 168 days in the last three months, our green card was expected around February 26, 2025. And it is not here. Both Denver and LA have 14 months average time to process adjustment of status, according to USCIS. So we would be waiting until October. So first question is, is it worth it now to apply for the SSN? At College, my teen was going to be awarded $400 a month as an incentive, and she lost it al because of not having an SSN. Now we are thinking about university and again the SSN might be an issue. Second question is on the medical. We had a medical in London, UK. All was well but we deferred both Covid vaccine and Flu vaccine, and the HEPATITIS series for my daughter (there needs to be a space between shots so she had the last one here) In September we had the Covid vaccine here in the USA. But due to both of us having a MTHFR mutation, we respond far too robustly to medications and vaccines, so we have tried not to have another flu vaccine, which invariably causes flu and malaise in both of us. So far the USCIS page tells us our case will take 12 months and has not asked for medical records. At what point will they ask for them? Do they always ask for them? I asked my doctor an estimate- she is also an authorized immigration doctor - and to add a note with the new jabs she asked for $350 EACH. I'd rather just bring the receipt from Walmart Pharmacy...as other people here have done. Is it okay? Is there any way to skip the flu vaccine? Is it worth filling the I-765 and then the GC arrives anyway? Thanks!
  11. Yes that’s my daughter. We are planning to fill the permission to work form today. It sucks to pay $260 for it but the SSN is necessary and I don’t see why we should wait until the green card arrives. But if you got it so quickly I am now in doubt. the case in the Uscis page says we have passed the interview stage and they are since September at decision stage, due in 12 months -presumably 12 from filing for AOS. However I do not understand the processing times statistics well enough to determine if we are due soon or not. in which case if we are due in two or three months there is no point in filing for her to have SSN. she attended college and if she has had SSN, she would have qualified to receive $400 a month as an incentive. Had I known this from the beginning I would have filed for both immediately 🤪
  12. hi there! We filed for AOS in August, too. Our USCIS page says that the waiting time will be about 12 months. We had our biometrics and I received my SSN card and work permission in November. Now we are thinking about filing the I-765 for my 17 y.o. daughter so she can finally use the SSN and maybe work, as the Green Card might take ages to arrive. It's a bit confusing - we arrived with a K1 and now I don't even know if I can file the I-765 under a c9 category (K2 for my teen), and it's not clear if we can do this online or on paper and where to submit the supporting documents. Good luck everyone! (PS So far I spent over 2k in medical expenses that would have been free in the UK LOL)
