  1. You've misread me. Unlike you, I am actually an advocate of opening our borders to immigrants that are from countries where due to the political climate the people of this area have their lives in danger. That would include support for countries like Venezuela, Haiti, and even South Africa where your life is at risk daily from gangs, unlawfulness, oppressive regimes, etc. I do think that the process should have some level or order and background checks, such that we can protect US citizens from potential criminal immigrants. It should also include a plan for how the people arriving will become productive members of society. I am pro-lawful-immigration and for helping people from countries where their lives are at risk. We can't save everyone, but if we can save a few and they can give back to our society, then I welcome them. I am not against this SA refugee program by Trump, I merely find it quite hypocritical for Trump to actively target lawful immigrants that arrived on Biden's CHNV program, and be vocal about how it was illegal for Biden to do that, and then turn around and do the exact same thing for SA. If Trump wasn't actively attacking lawful immigrants that arrived on CHNV, then I never would have shared this news article. I am pro-SA refugee program, but I think if you are going to support one program and not the other then you should own being a hypocrite and not make excuses for it.

  3. Yeah I know even though I agreed to be the financial supporter via i-134a that the financial support I agreed to wasn't enforceable. But for me, just because they could have previously qualified when they came, I wanted to fulfill my unenforceable obligation as a financial supporter because that was the agreement I made with the federal government when they allowed the people I sponsored to come. I don't like taking advantage of loop holes or grey areas, and prefer to live my life as honorable as I can. My financial obligation was only for the 2 years of their parole window though, and now that this has ended, so ends my honor-system financial obligation. And if USCIS would approve either of their two applications that have been sitting untouched for a year+ than they wouldn't need any form of public assistance. That's the thing that rubs me wrong. Here are people that a legally here, that are following the laws of the country, and want to pay into US systems like income tax, social security tax, medicare tax, and 401k retirement plans... and the Trump administration is preventing this. So yeah, when the US government is operating unethically, I have no issues with people like this going on public assistance (assuming they qualify) because the US gov is causing this issue.
  4. I am not experienced in the welfare system, as I've never received any form of public assistance. Certainly to get benefits you'll need to be a documented immigrant with a valid social security number (Both true for my MIL). I know that when there are children involved there are special rules and they have flexible programs for that (They have a son). I suspect living in a very liberal state on NY that will help them receive benefits, but I guess I'll find out in a few weeks or so if they decide to apply for benefits. I told them they should. I financially helped them when they arrived as was my obligation when I agreed to be their financial sponsor and as such they haven't been on social assistance yet. But now that my obligation is over, I don't feel that it would be fair that I financially care for them because Trump's administration chooses not to allow them to work while being legally here. They told me they would rather work illegally because their employer isn't checking people's EAD expirations. They were thinking if their employer doesn't tell them they can't work than the US gov would be forgiving of that if they did. I'd beat it into their heads enough now that they get it. I told them this is exactly what Trump want's them to do, because working illegally is grounds for a denial of their permanent residency. So they wont be working, but they are pretty upset about it. It is what it is.
  5. That ruling was a great step in a positive direction, however that just prevented the premature ending of the program. My MIL (I am a USC and with her daughter) has her parole ending May 15th.. It's the end of her 2 year temporary stay. However she doesn't need to leave because during this temporary stay she found a legal path to citizenship that she qualifies for, and paid her $1,440 for a residency application and paid her $260 for EAD. Is these two applications that USCIS has (per memo) put on hold. It's fine though... We have read all the immigration law surrounding Residency via CAA. I am current on all areas that she could be denied on, and she will make sure she is following all the US laws and application rules such that USCIS has no basis to deny residency. Until then, she relies on public assistance until she can start her life here again in the USA. Until then though she has legal stay in here because having a pending i-485 gives her "protected stay"

  7. She originally filed EAD under C-11 Cuban Humanitarian Parole and a year ago she filed for i-485 based on Cuban Adjustment Act and she did file a new EAD request under C-9. Pending applications for a year+ now. Trump however had directed USCIS to not process lawful applications such as hers and because of this she loses her jobs in a few weeks even though she has multiple pending applications. The good news for her is she will still qualify for all the state aid and such so she will get tax payer funded Medicaid, SNAP (Food allowance), Rent allowance, Cash allowance and everything else her family qualifies for due to Trumps administration taking away her ability to legally work and pay taxes in this country. But she is just trying to maximize the money she can get from her employer before she is forced onto public assistance, hence my question. My theory is that Trump has directed USCIS not to process applications like her such that when her C-11 EAD ends, then people will mistakenly keep working which then makes them do illegal actions in this country and as such that would be grounds for denying their permeant residency. I am sure Trump will catch and deport a lot of immigrants by using this strategy. Or by not processing EAD's and taking their ability to work away long enough, maybe some will self-deport. Good news for my MIL though, i-485 based on CAA isn't subject to public discharge so she can get all the tax payer support necessary until Trump finally gives and allows her applications to be processed. If you've read this far, know this - My MIL absolutely hates the idea of going on Public assistance. She loved that for the first time in her life she was able to actually work a job and earn a livable wage. She loved that Walmart offered a 401k Plan and she participated in that. She didn't mind paying taxes and wasn't on any form of government assistance. I've tried escalating her cases due to this being a family of three and she's the primary source of support. Wont do much good im sure.
  8. My MIL's EAD is expiring in a few weeks and USCIS is no longer processing EAD's from people like her. She plans to not illegally work, because she doesn't want to give the Trump administration a reason to deny her pending i-485 (1+ year pending now). Anyways, Walmart where she works gives her Vacation. I think the Vacation paid out like days she would be working. So if her EAD expires on 5/10, could she take 7 days of vacation for 5/11-> +7 days? Or do you think it's safer to have her vacation days get paid out for days she would have worked before her EAD expires? Is this question clear? For my job if I were to quit, they just pay me my unused vacation. But I don't think that's how Walmart works. I think she has to say she is taking vacation 5/11, 5/12, 5/13, 5/14,5/15... etc. Days she would have been scheduled to work she need to record vacation. So can she do that for days after her EAD expires or does it need to be before?

I guess the question I have now is this - They sent a yellow paper saying If we do file this benefit request again (checking 1(A) SMH) then I am supposed to place this letter on the top of the package. I would prefer to file again online because it's significantly easier than mailing. Can I just file this all again electronically the same way I did except with 1(a) selected? Should I scan this yellow letter and attach it to a new online benefit request? Not sure what to do here... any advice?
  10. Update - I found the error. When I printed the saved application - for whatever reason it unchecked the box in 1(a). SMH.
  11. Submitted the i-765 via online submission where it literally tells you what to upload. What we uploaded was as follows 1. Signed i-765 pdf that the USCIS online submission checks for accuracy and doesn't allow you to proceed until the system confirms it is correct 2. I-797C receipt of proof of pending i-485. The system also checks this for accuracy. I had to scan it a couple times before the system confirmed it and allowed me to proceed. 3. I-797C receipt for the most recent i-485 status. This was a receipt showing that they reused fingerprints. 4. Official I94 document - printed from the website. 5. 2x2 picture 6. Identity documented - Uploaded both NYS drivers license and current unexpired EAD card. Note - the USCIS website then checks the entire submission for completion and the website itself set the payment amount which was $260 dollars that consistent with the fee structure as their i-485 was submitted in June 2024 which is after April 1, 2024. Thoughts? What do you do when they reject an application saying you didn't provide something, but you did because it was automatically checked, and the automatic system then allowed the case to be created?
  12. I don't watch any news. Yes my personal experiences is exactly why I paint such a broad and derogatory view of what has been happening in this country. Some people in this tread are a perfect example of this... people who has gone through immigration process, and you'd think they would be sympathetic of other lawful immigrants also making a similar journey, but instead is jumping on the Trump bandwagon cheering to round them up and deport them because it's not their rights they are taking away. If you're an immigrant in this country, regardless of your status... you should be worried about the changing political climate. I've been in the immigration world for a half a decade. Never have I seen the level of racism and bigotry towards immigrants as I have seen since Trump took office for his second term. I am not seeing this from the media that I don't watch... I am seeing it on social media, sites like VisaJourney, sites like Reddit, Facebook, real life, all over..... Trump beats the drums and gives his followers justification for being vile towards honest lawful immigrants. When you don't care about other people getting their rights taken away, that's exactly how you lose yours.
  13. I started that paragraph I wrote with "What I am mildly worried about..." and then you want to say I am using some leftist playbook to stoke fear? I am literally talking about my own feelings and fears based on the atmosphere that trump has created in this country. Shouldn't I be allowed to express my own feelings based on what I perceive happening in the USA? Trump claimed he wanted to go after criminal illegal aliens, and now that's somehow morphed to going after lawful legal immigrants who came on Biden's parole. Note his own Gold Card program is the exact same immigration executive order that he states is illegal Biden did it, yet perfectly fine for him to do. Quite hypocritical. 6+ million immigrants crossed the border illegally under Biden, and projections are that 1.5 million will illegally cross the border this year under Trump..... Where is his priority of going after those illegal border crossers? Answer - It's harder to catch them, so lets go after the lawful legal tax paying ones who actually report where they are living.
  14. Agree with you 100%. They are wild, and they are unfounded, and they are only my own personal thoughts/feelings/opinions on where I could envision things going in this country. Do you have issues with me considering the possibility of what I previously wrote? What considering scenarios like I just mentioned does for me, is it gives me the ability to act quickly if it happens... while the rest of the world are stunned and in shock and scramble to figure out what to do. And I would hope that IF that happened that anyone here mocking my comments would say "Jeez. Wazzujoel was right. This is pretty scary that this is happening and i feel bad for what's happening to the immigrants who are affected".... But I suspect that those that are Trump supporters will just make excuses for why it is necessary to put these unfavorable immigrants into camps.
  15. This is excellent. you made me laugh. thanks! Correct she's fine. We are not worried about her status here. Just a little wild that USCIS sends out such an aggressive letter without doing any cross checking that it's even applicable to the person. She received this letter in her USCIS account, the very same account that has an approved i-485 application as the top case in her account. What I am slightly worried about is Trump declaring martial law due to either some gov-invented-event or due to "the crisis at the border", and then using that martial law in conjunction with the Alien Enemies Act of 1798 to round up and mass deport all lawful immigrants he views as unfavorable. I would expect in this case that any immigrant lawfully following the rules (green card or not) will be rounded up first and instantly sent away, and I don't think he will target only immigrants from CHNV. Expect immigrants of all legal classes from countries trump views as unfavorable (Central and south America, middle east) shall be picked up and sent away. And you might be reading this and rolling your eyes and thinking "he's not going to do something like that", and I reluctantly agree, but I could totally picture this being apart of his game plan and that's what is scary. I wouldn't have ever said anything like that under Bush, Clinton, Bush Jr, Obama, Biden, or even Trumps first term.... Now - this doesn't feel out of the realm of possibilities. And his base would just cheer for this injustice because "immigrants are ruining this country and it's time to make America white and great again"
