    They did ask how long is she here for and she said a couple of months and she does have a return ticket. She recently got released from Army so not worried about travel/work. Just an fyi, we also have a 4-month old (born abroad) who is a us citizen cuz of me.

    I submitted an I-130 for my spouse online. One of the questions they ask is if the beneficiary will need Adjustment of Status and I replied no (they would be interviewing outside the US). My spouse is now in the US on a visit visa. Its been a month since I filed the application and the only correspondence I received from USCIS is a "Receipt Notice" so far. Is it ok to file I-485 even though I declined initially or just let the I-130 process and not give USCIS a reason to make things complicated for us?
