    From what you've stated you can file adjustment of status. Read the guides on here for the process. You are correct, overstay is forgiven for spouses of US citizens

    You can look at my timeline. First roc filed November 2020, denied sometime between October 2021 and January 2022 (uscic doesn't seem to agree with itself there). Second roc filed January 2022, approved July 2024

    I have also traveled internationally with a denied I-751 and a stamp from the second I-751. I had no issues

    We had a "courthouse" wedding. (Our state doesn't do weddings at courthouses). It was small wedding with me and my husband, 2 witnesses, an officiant, and a friend taking photos. No one else. We had no problem getting AOS approved (not a K1 case though). We had a big wedding on our one year anniversary, but my greencard was already approved by then.

    Thank you everyone for the answers. I think we're going to go ahead and apply. If we get approved before our trip that's great. If not, we'll at least have it for our next trip.

    Hello, We (me: LPR, husband: US citizen) are planning on visiting my family over Christmas, and I was reading up on global entry. The official website states that they only recommend it for people who fly abroad 3 to 4 times a year. We're only planning on going abroad once this year, but I'm still thinking about getting it. I know it would be $200 but it would alleviate a lot of stress during travel. Would it be worth it?

    No one here is going to advice you to do that because it would be fraud. You clearly have intentions to get married and adjust status. Coming back into the country on a non immigrant visa knowing you are about to apply for adjustment is a big no-no. Unfortunately it looks like your best option is to apply now, include I-131, and hope that at least that part will be approved by the time your trip comes around. And if not, you'll have to cancel or reschedule.

    File a G-1145 with your application to get a text when they open your case, or pay with a personal check and check your bank account for when they cash it

    And as mentioned above, she needs to be upfront about everything. Answer yes to overstaying, and yes to working illegally. Both will be forgiven.

    January 2022- just got approved, no N-400 filed, no RFE, no interview

    Just checked my mail while at work and saw an envelope from uscis waiting for me. So I immediately checked myuscis, kinda scared since the last time I got a random letter from uscis it was the denial of my first I751. I thought it might be an interview or biometrics notice. Lo and behold, instead I see this. So after almost 4 years, 1 denial, multiple nervous breakdowns and call to uscis that led to nowhere, 2 ADIT stamps, and not a single interview or biometrics appointment (I was sure they would need to redo them since my biometrics are from 2018!), I am finally DONE! Maybe one day Austria will change the law about dual citizenship and I'll apply for citizenship, but for now, I will gladly leave uscis in my rear view mirror.

    You need to file AR-11. It can be filed online. You are supposed to file within 7 days of moving, but better now than never. If your sponsor also moved, they need to file I-865, which cannot be filed online.
