Hello Wonder-Full VJ Community,

Well, my life story is in here somewhere (Canada threads) so this is a follow up.

On the DS 156 form

page 2

question 38

the first bullet:

There are 2 questions, and I am a yes on the first and a no on the second.

What do I check?

Probably obviously YES, right?

On DS 230 part 2

page 3 of 4

question 30

part b:

here we go again with the crime of immoral blah blah, sorry

being none of us are sure about whether I would be construed as such

maybe I should put NO and be ready to tell my story at the Mtl. Consulate?

Any one reading this, and has had any similar stories, care to share your experience with me?

Tied the knot (legal ceremony, part one) – January 26th, 2008 (kinda spontaneous)

AOS: Mailed V-Day; received February 15th, 2007 – phew!

I-485 application transferred to CSC – March 12th, 2008

Travel/Work approval notices via email – April 23rd, 2008

Green card/residency card: email notice of approval – August 28th, 2008 yippeeeee!!!

Funny-looking card arrives – September 6th, 2008 :)

Mailed request to remove conditions – July 7, 2010

Landed permanent resident approved – August 23rd, 2010

Second funny looking card arrives – August 31st, 2010

I may be over analyzing this...but if you really aren't sure Spirit - if it was me I would answer no. Here is my theory. It seems to me that in a few cases at least, there is a whole covering your butt mentality in these places. If this is true then if you answer yes, I don't know that you can rely on them to do their due diligence and research it and even if they do, they may not come to the correct conclusion.

So then you just have someone wrong saying "oh yeah, definately CMT - book em danno" - without discussion instead of the reverse.

Does this make sense ? :blink: IR5 do you believe it does fall under CMT?

I think it all depends on whatever it is you were arrested for or charged with. I searched through the threads here but couldn't find your story, so I don't really know what your "crime" was, but I too would think carefully before checking off a yes for a CIMT. As trailmix said, I wouldn't trust whoever looks at your form quite enough to hope they look into matters further or ask questions before just declaring you ineligible to receive a visa.

The definition of a CIMT is so broad and subjective that one person may look at if differently than another. I'm sure giving someone a wedgie these days could be stretched to fit the definition of a CIMT, but I sure as heck wouldn't check off "yes" for that on my form.

Did you look through IR5FORMUMSIE's thread on what constitutes a CIMT? There may be some helpful info there.

June 4/07 Mailed DS-230 via overnight delivery.

June 7/07 DS-230 entered into the system

June 18/07 Case Complete!

July 25/07 Medical

September 4/07 Contacted State Senator Re: MTL backlog

Dec.6/07 INTERVIEW..... APPROVED!!!! (After being kept awake all night in dirty clothes standing outside my hotel because Air Canada lost my luggage and my hotel started on fire. Meh, sleep is highly over-rated anyways.)

Dec.18/07 Moved to the US

Oct. 29/09 Citizenship Oath Ceremony

Yes. I believe it does. What I think of the USCIS' arbitrary and capricious definition, on the other hand, is hardly the topic of polite discourse.

Ditto. Better to be upfront and then explain the circumstances me thinkssss, than say "nope, never" and be denied for misrepresentation or whatever it's called.

Technically it is a crime of omission but the USCIS only sees it as one thing, fraudulent misrepresentation to gain immigration. Like Buckley's it may taste like ####### but hold your nose and it will be over in a little while. Now is not the time for hubris. Remember you are not really an applicant but more of a supplicant. :) Now get down and grovel! :lol: Hmmm...sounds strangely like something Len might say when wearing her Lady Heather outfit. :lol::lol:

My trepidation is being labeled as such on some immigration government computer system and then down the line, I apply for my AOS, etc. and they look and lo-and-behold A "CRIMINAL!"

sigh...

My gut says to say no to that second question on form 156 about the CMT, and my head, well, there is a battle going on.
