UK OVERSTAY ON PASSPORT 2002

Hi Guys i just thought I would throw this concern out there as im hoping this will not cause my fiance and I any issues with our K1 Visa approval. My fiance went to the UK on his passport in 2002 and he stayed there until 2005. Was in England for 3 months and then the rest was spent in Scotland. He says he filed for assylum and while that was being waited upon the goverment gave him some documentation for attending school and for getting apartment. However the assylum never went through and he had to return to Jamaica. Please tell me what you think. Its not like he has any criminal records or anything. Help!!

Well if he would of stayed in the US for this amount of time,then I would of said it would be an issue. Seen as it is in the UK I dont really think so.

He will have to list his time in the UK on the G 325a. Also, when it comes time for the visa interview, he will have to get a police certificate from any country in which he spent more than 6 months - this would include the UK. That police report does not cover immigration issues (at least not to my knowledge).

My gut feeling is that this will not be an issue for the visa (since he does not have any criminal convictions), and he did what the UK immigration officials asked him to do (went back to Jamaica once his asylum was denied).

However, it might benefit you to have a consultation with an immigration attorney to make sure they do not see any issues with it.

Thanks!!!! He was in england 3 mos and scotland a few years so im waiting on those reports to be delivered via mail those take forever!!
