We got my wife's AOS Fee bill in the mail, which I'm assuming is related to her I-130/CR-1. She's already here on a K3 and we've already filed I-485 & I-864 here along with those fees.

Do we still need to do anything with this bill? How about the DS-3032? I'm guessing we just update her address with the DS-3032, but it's also asking us to choose between:

[ ] I have already legally immigrated to the US and do not neeed to apply for an immigrant visa. I received by Green Card through the ____________ (city) BCIS office. My A# is _____________.

[ ] I no longer wish to apply for an immigrant visa.

I don't think we can say she's "legally immigrated" since the K3 is a non-immigrant visa. Or can we? She has an A# on her K3, but no Green Card yet.

It feels weird to check the second box...

Seems like they need a third box:

[ ] I am in the US on a K3 and am in the process of adjusting status here.

How do we tell them that without potentially shooting ourselves in the foot?

I've sent an email to NVCInquiry@state.gov, but that generally takes 3-4 days to get a response from.

Thanks,

KZ

Check box b on the DS-2032 that you no longer wish to get an immigrant visa. Notice that it says immigrant visa... that isn't the same thing as "permanent resident status". Also include a letter stating that you are in the US on a K3 and are applying for permanent resdient status through the USCIS and wish to have the approved I-130 petition sent back to the USCIS and send the DS-2032 back to the NVC. Do NOT pay the fee bill...
